RESOLUTION NO. 105-2010
AWARDING A CONSTRUCTION CONTRACT, ACCEPTING A GRANT OF
EASEMENT, AND TRANSFERRING FUNDS FOR THE WOODBINE PEDESTRIAN
BRIDGE REPLACEMENT PROJECT,
CIP NO. B-512
WHEREAS, the Danville Town Council approved a call for bids for the Woodbine
Pedestrian Bridge Replacement Project, CIP No. B-512 in Resolution No. 79-2010; and
WHEREAS, the City Clerk of this Town did, in open session on the 24th day of August,
2010, publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, the lowest responsive bidder is Jim Freethy Excavating, Inc. of Danville, CA,
and the City Engineer has recommended awarding a contract for the project to said firm;
and
WHEREAS, funding for the project has been appropriated in the 2010/11 through 2014/15
Capital Improvement Program (CIP), although a funding shortfall exists; and
WHEREAS, funds must be transferred from Park Facilities Revenue in the amount of
$6,313 to fully fund the project; and
WHEREAS, the Green Valley Shopping Center has executed a Grant of Easement that will
allow the Town to construct the southern portion of the bridge, and will allow the public to
utilize the bridge, approach driveway and walkway on shopping center property in
perpetuity; and
WHEREAS, the Town must accept the easement; now, therefore, be it
RESOLVED, by the Danville Town Council, that the Town award the construction contract
for the Woodbine Pedestrian Bridge Replacement Project to Jim Freethy Excavating, Inc. of
Danville, CA; and, be it further
RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is
authorized to execute, on behalf of the Town, a written contract with Jim Freethy
Excavating for $213,089.30 and authorize use of a 10% construction contingency of
$21,308.93 for a total budget of $234,398.23 for work in connection therewith, and the City
Clerk is hereby directed to attest same and affix thereto the official seal of the Town; and,
be it further
RESOLVED, by the Danville Town Council, that $6,313 in Park Facilities Revenue be
transferred from CIP B-120 to CIP B-512 in Fiscal Year 2010/11 to fully fund the project;
and, be it further
RESOLVED, that the Danville Town Council hereby accepts the Grant of Easement across
Green Valley Shopping Center and hereby directs the City Clerk to attach an executed
Certificate of Acceptance to the Grant of Easement together with a certified copy of this
resolution, and have the Grant of Easement document recorded at the Contra Costa County
Recorder's Office; and, be it further
RESOLVED, that the City Clerk shall within five (5) days of the adoption of this resolution,
transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101.
(Note: Should a finding of any discrepancy regarding this ratio of apprentices to
journeymen be made, the Town shall notify the Division of Apprenticeship Standards of
such findings.)
