RESOLUTION NO. 104-2010
AWARDING A CONSTRUCTION CONTRACT AND APPROPRIATING FUNDS
FOR THE EL PINTADO ROAD PAVEMENT REHABILITATION PROJECT,
CONTRACT NO. C-402
WHEREAS, the Danville Town Council approved a call for bids for the EI Pintado Road
Pavement Rehabilitation Project, Contract No. C-402 in Resolution No. 78-2010; and
WHEREAS, the City Clerk of this Town did, in open session on the 24th day of August,
2010, publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, the lowest responsive bidder is MCK Services of Concord, CA, and the City
Engineer has recommended awarding a contract for the project to said firm; and
WHEREAS, funding for the project has been appropriated in the 2010/11 through 2014/15
Capital Improvement Program (CIP); and
WHEREAS, additional funds must be appropriated from Measure C/J Return to Source
Revenue in the amount of $44,809 to fully fund the project; now, therefore, be it
RESOLVED, by the Danville Town Council, that the Town award the construction contract
for the EI Pintado Road Pavement Rehabilitation Project to MCK Services of Concord, CA;
and, be it further
RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is
authorized to execute, on behalf of the Town, a written contract with MCK Services for
$158,588.00 and authorize use of a 10% construction contingency of $15,858.80 for a total
budget of $174,446.80 for work in connection therewith, and the City Clerk is hereby
directed to attest same and affix thereto the official seal of the Town; and, be it further
RESOLVED, by the Danville Town Council, that $44,809 in Measure CjJ Return to Source
Revenue be appropriated to CIP C-402 to fully fund the project; and, be it further
RESOLVED, that the City Clerk shall within five (5) days of the adoption of this resolution,
transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.o. Box 603, San Francisco, CA 94101.
(Note: Should a finding of any discrepancy regarding this ratio of apprentices to
journeymen be made, the Town shall notify the Division of Apprenticeship Standards of
such findings.)
