Section 2. Adoption of 1978 Zoning Haps with Changes.
(a) Purpose and Intent. Sections 84-2.002 of the County
Ordinance Code adopts as a part of the zoning regulations maps
showing t~e land use districts as established and existing on
December 12, 1978. Section 84-2.002 provides for the
maintenance and updating of all changes made after December 12,
1978, in the boundaries and designations of the land use districts.

In adopting Division 84 of Title 8 (comprising sections
84-2.002--84-84.404), it is the City Council's intent to include
in the adoption the 1978 Zoning Map of Contra Costa County
together with all changes made between December 13, 1978, and
July 1, 1982, in the boundaries and designations of the various
land use districts to the extent that those districts classify
and zone land situated in the City of Danville.
The City is newly incorporated and the City Council is
adopting by reference all of the land use district regulations
in effect in the County on July 1, 1982, the date of
incorporation. The purpose of this section is to provide that
the land use districts established for territory within the
City of Danville which are designated on the maps adopted by
section 84-2.002 and updated to July 1, 1982, are adopted and
continued in effect.
(b) Land Subject to Zoning. The use of all land In the
City of Danville which is located within the districts sho~m
on the maps described in this section and as adopted by
reference by this ordinance is subject to the provisions of
sections 84-2.002--84-84.404 of the County Ordinance Code as
adopted by reference by the City Council of the City of
Danville.
Section 3. References to Officials and Offices.
In the Ordinance Code of Contra Costa County and each of the
Uniform Codes adopted by reference, a reference to "Board of
Supervisors" means the City Council of the City of Danville; and a
reference to an office, official title or other designation means

the office, title or designation in t~e governmental structure
of the City, or if there is none, the official or title holder
in the City who performs the function or duty referred to.
Section 3. Penalties.
(a) In accordance with Government Code section 50022.4,
the following penalty clauses contained in the Ordinance Code
of Contra Costa County are enacted in full:
(1) Section 14-8.002, which reads as follows:
"14-8.002. Violation--Infraction.
Except as otherwise provided (and
regardless of the availability of
other civil or administrative remedies
and procedures for enforcing this code),
every act or condition prohibited or
declared unlawful by this code, and
every failure or omission to act as
required herein, is a violation of
this code and is an infraction."
(2) Section 14-8.004, which reads as follows:
"14-8.004. Violation--Punishment. (a)
Infractions. Except as otherwise
provided by statute or this code, every
infraction violation of this code is
punishable, upon conviction thereof, by:
(1) A fine not exceeding fifty dollars
for a first violation;
(2) A fine not exceeding one hundred

dollars for a second violation of
the same ordinance within one year;
(3) A fine not exceeding two hundred fifty
dollars for each additional violation
of the same ordinance within one year.
(b) Misdemeanors. Except as otherwise provided
provided by state law or this code, every
misdemeanor violation of this code is punishable,
upon conviction thereof, by imprisonment in the
county jail for not over six months and/or by
a fine of not over five hundred dollars."_
(3) Section 46-2.012, which reads as follows:
"46-2.012. Penalty for violation. Violations
of traffic orders adopted under this chapter
shall be punished as provided in California
Vehicle Code Sections 4000.1 and 42001."
(4) Section 416-4.604, which reads as follows:
"416-4.604. Enforcement--Penalties.
Notwithstanding Section 14-8.004, and pursuant
to Food and Agricultural Code 531401, violations
of Division 416 of this code, excepting Chapter
416-10 and Article 146-12.2, are ~unishable by
a fine of not more than fifty dollars for the
first offense, and not more than one hundred
dollars for the second or subsequent offense."
(5) Section 714-6.602, which reads as follows:
"714-6.602. Pena1ty--Designated. Every

violation of this division is declared to
be a misdemeanor, punishable on conviction
according to the provisions set forth in
Section 14-8.004."
(b) A person who violates a provision of the Uniform
Building Code, the Uniform Electrical Code, the Uniform Plumbing
Code, the Uniform Mechanical Code or the Uniform Housing Code,
as those codes are adopted by reference with amendments, is guilty
of a misdemeanor and shall be punished as provided in Section
14-8.004 of the Ordinance Code of Contra Costa County (as adopted
by reference).
Section 5. Declaration of Urgency and Effective Date.
This ordinance is declared to be an urgency ordinance for
the immediate preservation of the public peace, health, safety and
welfare. The facts constituting the urgency are these: Upon
incorporation on July 1, 1982, the City Council adopted Ordinance
No. 1 which under Government Code section 35441 continued in
effect all County ordinances for a period of 120 days. Unless
this ordinance takes effect upon adoption, there could be a
period of time during which no ordinances would be in effect.
Since the City is not yet prepared to adopt a complete set of
its own ordinances, the City would be without regulations in many
vital and important areas which require regulation and control.
This ordinance takes effect immediately upon adoption.
Section 6. Posting.
Within 15 days after the passage of this ordinance,
the City Clerk shall have it posted in three (3) public places
designated by Resolution of the City Council.
