Pursuant to Welfare and Institutions Code
Sections 850 ff. and 880 ff., the following
juvenile halls, homes, ranches and forestry
camps are established and are referred to in this
chapter as institutions:
(1) Contra Costa County Juvenile HaIl, at
Martinez, California;
(2) Contra Costa County Boys' Ranch, at
Byron, California;
(3) Contra Costa County Boys' Treatment
Center, at Martinez, California;
( 4) Community Day Centers in various

Article 11 02- 2.4
Supervision and Personnel
1102-2.402 Supervision. The probation
officer and department shall manage and control
the internal affairs of these institutions, through
one or more superintendents who shall each be
in charge of one or more of the institutions.

1102-2.404 Personnel. All the compensated
personnel of these institutions are subject to the
county's civil service system and shall be
appointed by the probation officer, who shall,
subject to confirmation by the board of
supervisors, appoint the superintendent(s) and
be their appointing authority for purposes of
civil service regulations. (Ord. 70-59 ~ 2 (part),
1970).
Article 1102-2.6
Schools
1102-2.602 Schools - Established. Pursuant
to state statutes (e.g., Welfare and Institutions
Code Sections 856 ff. and 889 ff. and Education
Code Sections 11554, 18355 and 18358),
elementary public schools, secondary public
schools and related activities are established in
connection with the institutions listed in Section
1102-2.202, except the community day centers.

1102-2.604 Schools - Maintenance. The
county superintendent of schools shall establish
and maintain these schools. (Ord. 70-59 ~ 2
(part), 1970).

Violations
1102-2.802 Violation Unauthorized
communication. No person shall, without the
express permission of the probation officer or
one of his deputies:
(1) Communicate with any minor detained or
sheltered in any juvenile institution, established
under Section 1102-2.202 or otherwise; or
(2) Bring to or take from, for or on behalf of
any such minor, any written matter, weapon,
instrument, drug, tobacco or alcoholic beverage.

11 02- 2.804 Violation Loitering. No
person shall loiter, prowl or wander in or about
any juvenile institution, established under
Section 1102-2.202 or otherwise, or the grounds
belonging or adjacent thereto, without apparent
reason or business and refuse to identify himself
and to account for his presence when requested
so to do by the probation officer or any of his
deputies or any peace officer, when the
surrounding circumstances would reasonably
indicate that his purpose or intent was to violate
the provisions of Section 1102-2.202 or of any
other statute or ordinance or to interfere with or
to disturb the orderly operation of the
institution. (Ord. 7(}.59 ~ 2 (part), 1970).
1102-2.806 Violation - Escapes. (a) No
juvenile lawfully placed or confined, in any
juvenile institution established under Section
1102-2.202 shall escape from or leave it except
as authorized.
(b) No person shall wilfully <ind knowingly
harbor or conceal anyone violating or
attempting to violate subsection (a), with intent
that he may thereby avoid or escape pursuit,
arrest or trial therefor. (Ord. 71-100 ~ 1, 1971).

The board of supervisors finds, on the basis of
local employment and educational conditions,
the state of the county jail facilities and' other
pertinent circumstances it has considered, that
the operation of Penal Code Section 1208
providing for the operation of a work -
educational - furlough program for county jail
prisoners is feasible as to employment and
education, and establishes a work - educational -
furlough program in this county. (Ord. 68-60 ~

1104-2.004 Administrator. The sheriff shall
perform the functions of the work - educational
- furlough administrator. (Ord. 68-60 ~ 1 (part),

1104-2.006 Intercounty agreements
delegation. Pursuant to Penal Code Section
1208.5, the board delegates to the sheriff as
work-furlough administrator its authority to
enter into agreements for intercounty transfer of
persons under work-furlough programs. (Ord.

General
1106-2.202 Applicability. This chapter
governs the operations of Buchanan Field, the
Contra Costa County airport at Concord,
California. (Ord. 73-49 @ 1 (part), 1973).
1106-2.204 Nonliability of county. The
county and its agents and employees operating
the airport assume no responsibility for damages
to property thereon of persons using the airport
fadlities, by reason of fire, theft, vandalism,
windstorm, flood, earthquake or collision, or for
injury to persons on the airport or using its
facilities. (Ord. 73-49 @ 1 (part), 1973).

Definitions
1106-2A02 General. Unless otherwise
specially provided or required by the context,
the following terms contained in Sections
1106-2A04 through 1106-2A38 have the
indicated meanings in this chapter. (Ord. 73-49
@ 1 (part), 1973).
1106-2A04 Aircraft. "Aircraft" means any
contrivance now known or hereafter invented,
used or designed for navigation of or flight in
the air. (Ord. 73-49 @ 1 (part), 1973).

11 06- 2.406 Airport. "Airport" means
Buchanan Field Airport operated by the county,
and includes all land set aside for that airport.

1106-2.408 Airport manager. "Airport
manager" means the manager of Buchanan Field
(or subordinates designated by him), appointed
by the public works director to manage,
superintend, control and protect the airport.

1106- 2.410 Business or commercia. activity.
"Business or commercial activity" means using
the airport for one or more of the following:
Conducting business or commercial activities;
carrying passengers, freight, express or mail for
hire; instructing in aviation or in any
aviation-related field for compensation; selling
fuels, aviation supplies or materials; renting,
selling, maintaining or servicing aircraft; or any
other aviation or nonaviation commercial
activity including the sale ofrefreshments or any
commodity or service and the offering or
soliciting of any act in this section. (Ord. 73-49
@ 1 (part), 1973).
11 06- 2.412 Commercial aircraft category.
"Commercial aircraft" means aircraft operated
by one or more of the following operators or for
one or more of the following purposes:
( 1) By a scheduled air carrier; a nonscheduled
service for freight express, passenger or charter
service; or an aircraft sales agency or dealer
(selling three or more aircraft a year); or
(2) For aerial application, rental, charter, air
taxi, advertising or instructional purposes. (Ord.

1106-2.414 F.A.A. "F.A.A." means the
Federal Aviation Administration of the United
States of America, as defined in the Airport and
Airway Development Act of 1970, including
future amendments. (Ord. 73-49 .~ 1 (part),
1973).
1106-2.416 Flying club. "Flying club"
means an association or group of four or more
individuals jointly owning or leasing one or more
aircraft where payment is made to. the club
management for the operating time of such .
aircraft by a member of the club only. (Ord.
73-49 @ 1 (part), 1973).

1106-2.418 Landing area. "Landing area"
means the runway and taxiway system
maintained by the airport for the landing,
taking-off and taxiing of aircraft, and includes
the areas between the runways and taxiways and
the necessary clearance areas. (Ord. 73-49 @ 1
(part), 1973).
1106-2.420 Noncommercial aircraft
category. "Noncommercial aircraft" means one
or more of the following:
(1) Personal aircraft not operated for hire or
remuneration, owned by not more than three
individuals and used in connection with the
owner(s) activities in a manner comparable to an
owner(s) use of a private vehicle;
(2) Corporate aircraft owned by a company
or corporation and operated for the free
transportation of its personnel, guests or
products;
(3) Flying club aircraft owned and/or
operated by a flying club. (Ord. 73-49 @ 1
(part), 1973);
1106-2.422 Operational areas. "Operational
areas" means any place on the landing area, and
also includes the public use taxiways and ramps
and the necessary rights-of-way and clearance
areas therefor, but does not include any such
areas under lease to a tenant or lessee on the
airport. (Ord. 73-49 @ 1 (part), 1973).
1106-2.424 Operator. "Operator" means
any person operating aircraft for pleasure,
passenger service, freight service, hire, charter,
flight instruction, business or test purposes, or as
a bailee whjleperforming service on aircraft.

1106-2.426 Owner. "Owner" means the
registered owner(s) of an aircraft according to
F.A.A. files and records, who, for purposes of
this chapter, shall. be deemed to be the legal
owner. (Ord. 73-49@ 1 (part), 1973).

1106-2.428 Ramp. "Ramp" means an area
designated as a ramp and used for parking,
maneuvering, loading, unloading and servicing of
aircraft. (Ord. 73-49 @ 1 (part), 1973).
1106-2.430 Road. "Road" means all areas
designated as public use roads or streets for the
use of ground vehicles, including ways open to
the public, but does not include any such areas

under lease to a tenant or lessee on the airport.

1106- 2.432 Servicing. "Servicing" of
aircraft means supplying them with oil and fuel
only. (Ord. 73-49 S I (part), 1973).
1106-2.434 Taxiways. "Taxiways" means
all areas designated as public use taxiways and
used for the movement of aircraft on the
ground, but does not include any such areas
under lease to a tenant or lessee on the airport.

1106-2.436 Tower. "Tower" means the
control facility established and operated by the
F.A.A., and includes the authority exercised by
the F.A.A. for the control of aircraft and motor
vehicle' traffic on the landing areas of the airport
and in the airspace above and within the airport
traffic area. (Ord. 73-49 S I (part), 1973).
11 06-2.438 Transient aircraft category.
"Transient aircraft" means aircraft for which a
storage permit or lease by the county has either
not been issued or has expired or been cancelled
for cause, and which are parked in the
operational areas. Transient aircraft are subject
to payment of landing fees and/or aircraft
storage charges at the daily rate prior to
departure unless credit arrangements satisfactory
to the airport manager have been made. (Ord.

Article 1106-2.6
General Rules
1106-2.602 Abandonment. No person shall
abandon any aircraft, motor vehicle or other
personal property on the airport. (Ord. 73-49 S
I (part), 1973).
1106-2.604 Conducting business. No person
shall engage in any business or commercial
activity of any nature on the airport except in
conformance with an appropriate lease or permit
and under such terms and conditions as may be
prescribed therein by the airport manager and/or
board of supervisors. (Ord. 73-49 S I (part),
1973).
1106-2.606 Advertising. No person shall
post, distribute, erect or display signs,
advertisements, circulars, printed or written

matter at the airport except with the approval
of, and in the manner prescribed by, the airport
manager. (Ord. 73-49 S 1 (part), 1973).
1106-2.608 Restricted areas. No person
shall enter any restricted area posted as being
closed to the public without prior authorizatioh
from the airport manager. (Ord. 73-49 S I
(part), 1973).
1106-2.610 Use of roads and walks. (a) No
person shall use the roads, walks, paved areas,
landing areas or restricted areas, so as to hinder
or obstruct their proper use, without permission
of the airport manager.
(b) The airport manager may exclude from
such areas any type of vehicle or equipment
whose operation would damage them. (Ord.
73-49 S 1 (part), 1973).
1106-2.612 Animals and birds. No person
shall bring or allow any animals, induding
falcons, on the airport for training or hunting.
Every person bringing' an animal or bird on to the
airport shall keep it leashed, caged or physically
restrained so as to be under control of such
person at all times. No person shall hunt, pursue,
trap, catch, injure or kill any animal or bird on
the airport without authorization of the airport
manager. (Ord. 73-49 S 1 (part), 1973).
1106-2.614 Firearms. No person (except
duly authorized peace officers, ,md post office,
airport or air carrier employees, arid members of
the armed forces of the United States on official
duty) shall carry any firearms, BB or pellet guns,
explosives, bows and arrows or flammable
materials on the airport without the written
permission of the airport manager. (Ord. 73-49 S

Land Transportation
1106-2.802 General. No person shall park
or operate a vehicle on the airport other than in
the manner and at locations indicated in
designated areas. (Ord. 73-49 S I (part), 1973).
1106-2.804 Operator's license.' No person
shall operate motorized ground equipment of
any kind on the airport without a valid vehicle
operator's license. (Ord. 73-49 S 1 (part), 1973).

1106-2.806 Motor vehicle permits. (a) No
person shall operate any motor vehicle in any
operational area without having first obtained a
permit from the airport manager. A permittee
shall have his permit in his possession at all times
during such vehicle operation. Applications for
permits as described herein shall be made in
writing. Any permit issued under this section
may be revoked for good CaUse by the airport
manager at any time.
(b) The airport manager may restrict certain
vehicle operations to, or exclude them from,
certain portions of the operational areas. (Ord.

1106-2.808 Radios and other equipment.
The airport manager may require that motor
vehicles be equipped with functioning two-way
radio and approved identification flags or
markings, (Ord. 73-49 ~ 1 (part), 1973).
1106-2.810 Taxis and similar vehicles. No
operator of a common carrier vehicle or vehicle
for hire shall load or unload passengers or stand
or park at the airport at any place other than in
the area designated by the airport manager for

1106-2.812 Speeds. No person shall operate
any motor vehicle, except emergency
equipment, in excess of speed limits indicated
by posted traffic signs, and in no event in excess
of twenty miles per hour. The airport manager
may have vehicles that are parked in places and
in a manner that hinders any approved operation
or that is in violation of the regtllations of this
airport towed or otherwise moved at the owner's

1106-2.814 Repairs. No person shall clean
or make any repairs to motor vehicles on the
airport at other than in designated shop areas
without permission of the airport manager,
except minor repairs necessary to remove such

1106-2.816 Runways. No person shall
operate any vehicle on the airport closer than
two hundred feet from the edge of the runways
or across any of the runways prior to receiving a

aircraft shall at all times have right-of-way over
ground vehicular traffic. No person shall operate

shall drive a vehicle between an aircraft and a
gate when such aircraft is enplaning or deplaning

1106-2.1002 Fees and charges. No person
shall remove any aircraft without having made
payment or satisfactory credit arrangements for
applicable charges for storage, landing. fees or
services rendered by the airport. (Ord. 73-49 ~ 1

1106-2.1004 Liens and impounds. The
airport manager shall have authority to place a
possessory lien upon and impound any aircraft
for delinquent charges due pursuant to Code of
Gvil Procedure Sections 1208.61 and following.

Aircraft, General
1106-2.1202 'Removal of aircraft. (a) Owner
Removes: Aircraft owners, operators or their
agents shall be responsible for the prompt
removal of disabled aircraft and parts from the
operational areas unless the airport manager or
federal authorities have delayed such action
pending investigation of an accident.
(b) Manager Removes: If the owner or
operator does not promptly remove a disabled
aircraft from the landing area, the airport
manager may tow it away or take whatever
action he considers necessary to make the area
safe for other aircraft, without liability for the
expense of such action or any damages caused to
the disabled aircraft. (Ord. 73-49 ~ I (part),

1106-2.1204 Liability. Any person who
destroys, injures or damages any airport
property, by accident or otherwise, shall be
liable for the cost of repair or replacement of
such property. (Ord. 73-49 ~ I (part), 1973).

1106-2.1206 Accident reports. Any person
involved in an accident on the airport shall make
a complete report to the airport manager as soon
after the accident as possible. (Ord. 73-49 @ 1

11 06- 2.1208 Aircraft repairs. (a) Repair
Areas: Owners and operators may perform
repairs upon their own aircraft if such work is
conducted in an area approved therefor by the
airport manager to avoid nuisance or hazard to
other aircraft, or the airport, or persons thereon.
(b) Minor Work: Owners may, between
sunrise and sunset in assigned public tied own
areas, perform inspections and aircraft repairs of
a minor nature not involving draining engine oil,
hydraulic fluid or fuel, or using solvents. (Ord.
73-49 @ 1 (part), 1973).
1106-2.1210 Uncompleted work. No person
shall leave any aircraft in a disassembled
condition on the public tiedown ramp, or leave
miscellaneous loose materials after departure
from the immediate vicinity, unless a written
permit issued by the airport manager authorizing
an extension of time to complete such work is
posted in a conspicuous location on the aircraft.

1106-2.1212 Work permit. No person, other
than the owner, may perform, or assist in, the
maintenance .or repair of any aircraft on the
operational area without first obtaining a permit
from the airport manager. (Ord. 73-49 @ I

1106-2.1214 Using another's property. No
person shall take or use any aircraft or other
personal property owned by any other person,
while it is stored or otherwise left on the airport,
without the owner's consent registered with the
airport manager. (Ord. 73-49 @ 1 (part), 1973).
1106-2.1216 Unattended aircraft. (a) No
person shall leave an aircraft unattended on the
airport unless it has been parked in an area
designated by the airport manager for the class
of aircraft and adequately secured. Owners are
liable for any damages resulting from failure to
comply with this rule.
(b) No person shall park, store or leave
un airworthy aircraft, wrecks, derelicts,
"junkers" or parts thereof anywhere on the
airport in public view. Such aircraft may be

parked or stored on leased areas or in hangars
awaiting bona fide scheduled repairs in a repair
shop operated pursuant to a lease agreement
with the county, or while being stored by
appropriate authority. The airport manager may
tow away, remove and store at the owner's
expense and without liability for damages any
aircraft or parts thereof stored or otherwise left
on the airport in violation of this rule. (Ord.

Article 1106-2.14
Aircraft Operation
1106-2.1402 Radios. No person shall land
or take off an aircraft unless it is equipped with
a functioning two-way radio and unless the pilot
maintains continuous communications with the
tower while operating within the airport traffic
area, except in case of emergencies or upon
receiving prior approval from the F .A.A. (Ord.
73-49 @ 1 (part), 1973).
1106-2.1404 Engines. (a) No person shall
start or run any aircraft engine unless a
competent person is attending the controls and
unless the aircraft is equipped with adequate
brakes, fully applied.
(b) No person shall run an aircraft engine in
front of or near hangars, other aircraft, shops,
buildings, personal property or persons, so as to
create a hazard or nuisance from the propeller or
jet blast.
(c) No person shall run engines or permit
engines to be run while passengers are being
enplaned or deplaned.
(d) The airport manager may establish and
designate engine run-up and test areas. (Ord.
73-49 @ 1 (part), 1973).
1106-2.1406 Experiment and
demonstration. No person shall conduct
experimental flights or ground demonstrations
on the airport without permission of the airport
manager. (Ord. 73-49 @ 1 (part), 1973).
1106-2.1408 Clearance required. (a) No
person shall taxi or take off in any aircraft in the
event the airport manager has refused clearance.
(b) The airport manager may refuse clearance
or take action to physically delay any aircraft
departure or other operations at the airport, for
any emergency or other cause (including the
condition of the aircraft or operator) which

might endanger the pUblic, or which would be
an impending violation of regulations applicable

1106-2.1410 Air rules. No person shall
conduct aeronautical activity except in
conformance with current federal aviation
regulations. (Ord. 73-49 @ 1 (part), 1973).
1106-2.1412 Operating restrictions. Unless
otherwise directed by the tower, no person shall
do or permit any of the following with an
aircraft:
(1) Fly below established traffic pattern
altitude for that class of aircraft, except in
emergencies;
(2) Taxi at an unsafe and unreasonable speed,
and never over fifteen miles per hour;
(3) Take off or land except in conformance
with the approved traffic pattern, except for
emergency landings;
(4) Cross any runway until the pilot has
stopped and made certain by visual inspection
that there is no danger of collision with any
aircraft, vehicle or object;
(5) Except in an emergency, turn after
take-off until reaching the airport boundary and
attaining an altitude of at least five hundred feet
and until ascertaining that there will be no
danger of turning into the path of a following

Article 1106-2.16
Flying Clubs
1106- 2.1602 Owner registration. In order to
be classified in a noncommercial category, the
registration certificate of flying club aircraft
shall bear the name of a nonprofit corporation,
or if not incorporated, the individual names of
all club members as co-owners. For this purpose,
the legal owner is deemed to be the person(s}or
corporation whose name(s) appears on the
F.A.A. registration certificate. (Ord. 73-49 @ I

1106-2.1604 File documents. Every flying
club shall submit to the airport manager upon
his request a complete and current list of its
members, rules, articles of incorporation,
by-laws and regulations governing the flying

1106-2.1606 Instructors. Every flying club

shall submit to the airport manager upon his
request a certified list of all instructors who are
or have been instructing members of the club,
and of the names of every member who received
such instruction with the date(s) and time
duration of such instruction within the six
months preceding the request. Failure to comply
with this request may be considered sufficient
grounds for termination of the club's

Enforcement
1106-2.1802 General. The provisions of this
article are applicable to violations of this chapter
whether or not those of Chapter 14-8 of this

1106-2.1804 Eviction. The airport manager
may order any person to promptly leave the
airport who operates or handles any aircraft,
vehicle, equipment or apparatus, or who uses the
airport facilities, in violation of the provisions of
this chapter or the regulations that may be
prescribed hereunder, or who refuses to comply
therewith. He may deny and prevent the further
use of the airport and its facilities for the length
of time required to ensure the safeguarding of
the airport and the public and its interest

the continued operation of the office or
department involved or are immediately
necessary for the preservation of life or
property. Emergency purchases shall be
subsequently approved and confirmed by the
purchasing agent; or, if he refuses to confirm,
the board of supervisors may subsequently
approve and confirm the purchase by a
four-fifths vote of the whole board. Unless
purchases are approved and confirmed either by
the purchasing agent or by the board of
supervisors, the cost shall not constitute a legal

Procedure
1108-2.402 Procedure - Revolving fund.
There is established from the unappropriated
funds of the county a revolving fund in an
amount that the board of supervisors may
establish from time to time by resolution. The
fund shall be known as the purchasing
department revolving fund. The purchasing
agent may purchase supplies and materials in
quantity for offices and departments of the
county as needed, and he shall make payments
for them out of the revolving fund. As the
supplies and materials are issued to an office or
department, the fund shall be reimbursed from
the budgeted funds of the requisitioning

only on proper written requisitions, the forms of
which shall be supplied by the purchasing agent
to the offices of the county. The head of any
county office, department, or institution, or his
duly designated assistant, is authorized to draw
requisitions for purchases for the office,
department, or institution in accordance with
current budget accounts. The head may delegate
this authority to one or more of his deputies,
assistants, or employees within the department
by filing a written authorization with the
purchasing agent and the auditor-controller.

1108-2.406 Procedure - Competitive bids
not required. Except as otherwise provided by
ordinance or general law, the purchasing agent
may make any purchase of personal property or
do any other thing authorized in this chapter
without notice, advertisement, or the securing of
competitive bids or quotations. However, if he
purchases any individual item (as distinct from
the total contract) costing more than five
thousand dollars without securing competitive
bids or quotations, he shall report this action to
the county administrator with his reasons; if he
does call for competitive bids or quotations and
accepts any bid or quotation other than the
lowest on any individual item costing more than
five hundred dollars, he shall report that fact to

1108-2.408 Procedure - Posting notices of
sales. Notice of sale of surplus personal property
shall be posted for not less than five business
days before the day of sale in the County Court
House, in the office of the purchasing agent, and
in another public place within the county that
the purchasing agent may deem advisable. (Prior

1108-2.410 Procedure Advertising
proposed sale. In the disposition of any surplus
personal property and on approval of the board
of supervisors, the purchasing agent may
purchase advertising space and may advertise the
proposed sale or other disposition of the
personal property in the newspapers, magazines,
and other periodicals that in his judgment will
best publicize the proposed sale or other
disposition to those persons most likely to bid
for or purchase the personal property. Within

1108-2.412 Procedure Surplus pool.
Whenever any item of personal property is no
longer needed by the office, department, or
institution in possession of it, this fact shall be
reported to the county administrator, who may
transfer the item to a surplus pool to be
maintained under the supervision of the
auditor-controller. Whenever any office,
department, or institution needs an item which
has been placed in the surplus pool or has
requisitioned the purchase of a similar item, the
purchasing agent may request transfer of the
item to the department on a properly drawn
request for transfer or requisition approved by

1108-2.414 Procedure Standards
committee. The board of supervisors shall
organize a standards committee to establish and
maintain standards of type, design, quality, or
brand of a certain article or group of related
articles or services purchased by the county. The
county administrator shall be chairman of this
committee, and other members that may be
deemed necessary shall be appointed from time

1108-4.002 Disposition. Except as
otherwise provided by state or federal laws, and
pursuant to the provisions of California Civil
Code Section 2080.4, the provisions of this
chapter shall apply to the care, restitution, sale
or destruction of unclaimed property. (Ord.

1108-4.004 Storage. All personal property
which has come into the possession of the
sheriff and has been unclaimed by the owner
shall be stored in a safe place for a period of at
least four months, except in the case of bicycles,
which shall be stored for at least three months.

1108-4.006 Claims by finder. Property
received by the sheriff from a person who has
found or saved it and who has complied with the
provisions of Civil Code Section 2080.1 may be
claimed by such finder if no owner has appeared
and proved ownership within ninety days. Such
claim shall be made no later than ten days after
the expiration of the ninety-day period. Upon
satisfactory proof that the finder has published,
after the expiration of the ninety-day period, a
notice of the found property in a newspaper of
general circulation published in this county, and
upon payment of reasonable storage costs, the
sheriff shall, if the property remains unclaimed
by the owner for an additional ten days from
the date of publication of the notice, transfer
the property to the finder. This section shall not
apply to property found in the course of
employment by an employee of any public

1108-4.008 Sale. At any time after the
expiration of four months (three months in the
case of bicycles) and ten days from the time
unclaimed property is stored by the sheriff, he
may, subject to the provisions of Section
1108-4.006, sell any or all of it to the highest
bidder at public auction, after giving notice of
the sale at least five days before the time fixed
for the auction by publication at least once in a
newspaper of general circulation published in
this county. This notice shall contain a general
description of the property and the time and
place where the sale shall be held. (Ord. 68-15 ~

1108-4.010 Disposition of unsold,
perishable or dangerous property. Any
unclaimed property for which no bids were
received at public auction, perishable goods,
property which is dangerous in itself, and
property which is contrary to public policy for
the sheriff to retain shall be disposed of in the
manner that the sheriff in the public interest
may determine. This chapter shall not apply to
property subject to confiscation or special
disposition under state or federal law. (Ord.

1108-4.012 Disposal of deadly weapons.
Any unclaimed pistol, revolver, or other firearm
capable of being concealed upon the person,
which has been stored by the sheriff pursuant to
Section 1108-4.004, shall be disposed of in the
manner that the sheriff in the public interest

1108-4.014 Disposition of toys and
bicycles. Toys and bicycles in the possession of
the sheriff, which have been unclaimed for a
period of at least three months, instead of being
sold at public auction to the highest bidder,
pursuan t to the provisions of Section
1108-4.008, may be turned over to the county
probation officer for use by him in any program
of activities designed to prevent juvenile
delinquency in accordance with Welfare and

1108-6.002 Resolution of intention. (a)
Except as otherwise provided in this chapter,
before ordering the lease of any real property
belonging to the county, the board of
supervisors shall, in a regular open meeting by a
two-thirds vote of all its members, adopt a
resolution declaring its intention so to lease and
calling for bids thereon.
(b) The resolution shall:
(1) Describe the property sufficiently to
iden tify it;
(2) Specify either the terms of the lease
including minimum rent, or refer to a proposed
form of lease filed in its clerk's office containing
this information; and
(3) Fix a time (at least three weeks
thereafter) for a public meeting of the board at
its regular place of meeting, for receipt and
consideration of sealed proposals for the lease.

1108-6.004 Notice. Notice of the resolution
and meeting shall be given by posting certified
copies of the resolutions in at least three public
places in the county for at least fifteen days
before the meeting's date and by publishing
notice of the call for bids for at least two weeks
in a newspaper of general circulation published

1108-6.006 Written and oral bids. At the
time and place fixed, in open session, the board
shall open and examine all sealed written
proposals, and declare those which are from

responsible bidders and which conform to the
terms and conditions in the resolution. The
board shall then call for similar oral bids
exceeding by at least five percent in rent the
highest such written proposal. (Ord. 69-80 ~ 1

1108-6.008 Final acceptance or rejection.
At the same meeting or at any adjourned session
thereof, the board shall consider all such
proposals and bids, and shall by resolution either
accept the highest such one or reject them all
and withdraw the property from lease. (Ord.

1108-6.010 Execution of lease authorized
by resolution. Any board resolution accepting
any bid authorizes and directs the chairman or .
the members thereof, to execute a lease and to
deliver it upon lessee's performance of and
compliance with all the terms or conditions of
his contract to be performed concurrently

1108-6.012 Exclusion from bidding
procedure. Any proposed lease, of not more
than one year duration and four hundred dollars
monthly rent, is excluded from the bidding
procedure provided by this chapter. Any
executed lease so excluded shall not exceed five
hundred dollars actual monthly rent and one
year duration and shall not be renewable. (Ord.

1108-6.014 Exceptions. This chapter
provides an alternative leasing procedure only
for real property which otherwise must be leased
in accordance with Government Code Sections
25526 to 25535; and it does not apply to real
property leased pursuant to Streets and
Highways Code Section 960.4 or Government

Definitions
1110-2.202 Generally. Unless otherwise
specially provided or required by the context,
the following terms have the indicated meanings

1110-2.204 Public works director. "Public
works director" means the county public works
director and includes any duly authorized sub-
ordinate. (Ord. 79-70 @ 2).
1110-2.206 Signposted park. A "signposted
park" is an area which is maintained as a county
public park and which is marked, pursuant to an
order of the board, with signs at all its entrances
and exits and at intervals of not more than one
mile around its perimeter, indicating that this
chapter prohibits within the park area the
conduct or activity specified on the signs. (Ord.

Motor Vehicles
1110-2.402 Prohibitions. No person shall
operate a motor vehicle, as defined in Vehicle
Code Section 415, in a signposted park. (Ord.
79-70 ~ 2, ~ 46-4.012(a), Ord. 71-42.~ 1: prior _
code ~ 3414(a)).
1110-2.404 Exceptions. This article does
not apply to the operation of:
(1) Any motor vehicle with the written per-
mission of the public works director;
(2) Any authorized emergency or main-
tenance vehicle whenever necessary in further-
ance of the purpose for which the vehicle has
been classed as an authorized maintenance or
emergency vehicle; and
(3) Any motor vehicle upon roadways im-
proved, designed, or ordinarily used for motor

Alcoholic Beverages
1110-2.602 Use prohibited. No person shall
drink any alcoholic beverage in a signposted
park. (Ord. 80-25).
1110-2.604 Exceptions. This article does
not apply when:
(1) The sale or service for drinking has been
approved and licensed by the appropriate state
agency; or
(2) Written county permission has been ap-
plied for and obtained from the public works
director at least forty-eight hours before such
consumption. (Ord. 80-25).

1110-2.802 Prohibition. No person shall re-
main in a sign posted park at any time during the
hours in which use is prohibited by board order

being carried on with the written permission of
