RESOLUTION NO. 53-2010
AWARDING A CONSTRUCTION CONTRACT FOR THE CAMINO
T ASSAJARA/CROW CANYON SAFETEA-LU IMPROVEMENTS PROJECT,
CIP NO. C-508
WHEREAS, the Danville Town Council has previously approved funding in the Capital
Improvement Program for the Camino TassajarajCrow Canyon SAFETEA-LU
Improvements Project, CIP No. C-508; and
WHEREAS, the funding includes two grants from the Safe, Accountable, Flexible, Efficient
Transportation Equity Act: a Legacy for Users (SAFETEA-LU), a federal grant program
administered by Caltrans; and
WHEREAS, Caltrans, acting on behalf of the Town, has determined that the project is
Categorically Excluded from requirements of the National Environmental Policy Act; and
WHEREAS, bids were solicited from contractors for the project; and
WHEREAS, the City Clerk of this Town did, in open session on the 6th day of May, 2010,
publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, of the eleven bids received, the lowest responsive bid was submitted by MCK
Services of Concord, California, and the City Engineer recommends awarding a
construction contract for the project to said contractor; now, therefore, be it
RESOLVED, by the Danville Town Council, that the Town award a construction contract
for the Camino TassajarajCrow Canyon SAFETEA-LU Improvements Project, CIP No.
C-508, to MCK Services of Concord; and, be it further
RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is
authorized to execute, on behalf of the Town, a written contract with MCK Services for
$3,891,771.04 which includes Bid Alternate A, but excludes Bid Item 67, and authorize use
of a 10% contingency not-to-exceed $389,177.10, for a total construction budget of
$4,280,948.14, for work in connection therewith, and the City Clerk is hereby directed to
attest same and affix thereto the official seal of the Town; and, be it further
RESOLVED, that the City Clerk shall within five (5) days of the adoption of this
resolution, transmit an Extract of Public Works contract award to the Department of
Industrial Relations, Division of Apprenticeship Standards, and P.o. Box 603, San
Francisco, CA 94101 (Note: Should a finding of any discrepancy regarding this ratio of
apprentices to journeymen be made, the Town shall notify the Division of Apprenticeship
Standards of such findings); and, be it further
APPROVED by the Danville Town Council at a regular meeting on May 18, 2010, by the
following vote:
