RESOLUTION NO. 134-2009
AMENDING THE TOWN/COUNTY JOINT POWERS AGREEMENT
(MAGEE PARK)
WHEREAS, on May 22, 1987, the Town of Danville and Contra Costa County entered
into a Joint Powers Agreement for the acquisition, development, management and
maintenance of the Hap Magee Ranch Park; and
WHEREAS, the agreement stipulates that the Joint Planning and Operations Committee
(JPOC) shall consist of five members - two members of the Contra Costa County Service
Area R-7 A Citizens Advisory Committee appointed by the Contra Costa County Board
of Supervisors, two members appointed by the Danville Town Council from the
Danville Parks and Leisure Services Commission, and a fifth member who shall be
selected by a unanimous vote by the four other JPOC members; and
WHEREAS, on August 11, 2009, the Contra Costa County Board of Supervisors
eliminated the Citizens Advisory Committee for County Service Area R-7 A effective
December 31, 2009; and
WHEREAS, on October 20, 2009, the Contra Costa County Board of Supervisors
appointed the Alamo Municipal Advisory Council, which will assume the advisory
functions previously performed by the R-7 A Committee effective January 1, 2010; now,
therefore be it; and
RESOLVED, by the Danville Town Council that the Mayor is hereby authorized to
execute, on behalf of the Town, an amendment to the Joint Powers Agreement (Magee
Park) regarding the change in County participation on the Joint Planning and
Operations Committee for Hap Magee Ranch Park.
APPROVED, by the Danville Town Council at a regular meeting on December 15, 2009
