HomeMy WebLinkAbout116-09 RESOLUTION NO. 116-2009 APPROVING A JOINT EXERCISE OF POWERS AGREEMENT FOR THE MAINTENANCE OF DIABLO VISTA MIDDLE SCHOOL PLAYFIELDS WHEREAS, in January 2004, the Town of Danville, Contra Costa County and certain developers entered into a Settlement Agreement regarding lawsuits filed by the Town over the County's approval of the Alamo Creek and Intervening Properties/Remaining Intervening Properties development projects; and WHEREAS, the Settlement Agreement called for creation of an assessment district to fund additional maintenance work on the playfields at Diablo Vista Middle School, with the funds paid to the Town or the San Ramon Valley Unified School District; and WHEREAS, the assessment district has been created and the School District has agreed to accept the funds directly from the County to perform the maintenance; and WHEREAS, the Town, County and School District have agreed that a Joint Exercise of Powers Agreement is the appropriate mechanism to allow for the collection, disbursement and use of the funds; now, therefore, be it RESOLVED, that the Danville Town Council approves the Joint Exercise of Powers Agreement for the Maintenance of Diablo Vista Middle School Playfields and authorizes the Town Manager to execute the agreement.
