HomeMy WebLinkAbout098-09 RESOLUTION NO. 98-2009 ACKNOWLEDGING RECEIPT OF THE DRAFT CONTRA COSTA COUNTY LAFCO CENTRAL COUNTY SUB-REGIONAL MUNICIPAL SERVICES REVIEW RECEIVED FROM LAFCO AND RESPONDING TO OPTIONS IN THE REPORT REGARDING DANVILLE'S SPHERE OF INFLUENCE WHEREAS, the Town of Danville has received notification that the draft Contra Costa County LAFCO Central County Sub-Regional Municipal Services Review has been completed and is available for review; and WHEREAS, LAFCO has indicated it plans to conduct a public hearing on September 8, 2009 to accept testimony on the draft Municipal Service Review (MSR) report, with the possibility of adopting the document at that meeting; and WHEREAS, the draft MSR report is organized by city and includes background on each Central Contra Costa County city, leading up to recommendations regarding whether or not the respective current Spheres of Influences (SOl's) should be expanded, contracted or left alone; and WHEREAS, the draft MSR review identifies two 501 options for Danville and recommends that LAFCO implement the second option and adjust Danville's 501 to coincide with the Contra Costa County voter-approved Urban Limit Line (ULL); and WHEREAS, if Danville's 501 were adjusted as recommended, approximately 335 acres of land currently within Danville's SOl west of the current Town boundaries would be removed from the 501 (with no change of the 501 along the eastern boundary of the city being necessary to reflect this 501 option); and WHEREAS, the Tassajara Valley Area is located adjacent to Danville's current eastern 501, and any future planning related to the Tassajara Valley Area has the potential to directly impact the Town; and WHEREAS, draft MSR report does not recommend inclusion of the Tassajara Valley Area within any city 501; and WHEREAS, the Town is preparing an update to the Danville 2010 General Plan and plans to utilize the general plan update process as an opportunity to consider options for expansion of the Town's 501 to the east, potentially including a portion of the Tassajara Valley Area; and WHEREAS, the Danville 2010 General Plan update and accompanying environmental review would then serve as a basis for formally applying to LAFCO at a subsequent date to adjust the Town 501 to the east into some portion of the Tassajara Valley; and WHEREAS, the town Council did review and discuss the draft MSR report, with focused consideration on the options and recommendations forwarded in the report pertaining to Danville's 501, at a noticed public hearing on September 1, 2009; and WHEREAS, the public notice of this matter was given in all respects as required by law; and WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now therefore, be it RESOLVED, that the Danville Town Council acknowledges the receipt of the draft Contra Costa County LAFCO Central County Sub-Regional Municipal Services Review and advises LAFCO that it has reviewed and considered the 501 options and recommendations contained in the draft MSR report; and, be it further RESOLVED, that the Danville Town Council advises LAFCO that it is preparing an update to the Danville 2010 General Plan and that the Town requests the opportunity to utilize the update process to consider the merits of formally applying to LAFCO at a subsequent date to adjust its 501 to the east into some portion of the Tassajara Valley.
