RESOLUTION NO. 95-2009
AWARDING A CONSTRUCTION CONTRACT FOR THE DIABLO ROAD/GREEN
VALLEY ROAD PAVEMENT REHABILITATION PROJECT, CIP NOS. A-365 AND
C-511, AS FUNDED BY THE AMERICAN RECOVERY AND REINVESTMENT
ACT OF 2009
WHEREAS, the Town Council authorized the submission of an application for American
Recovery and Reinvestment Act of 2009 (ARRA) funding and authorized the Town Manager
to solicit bids for the Diablo Road/ Green Valley Road Pavement Rehabilitation Project, CIP
Nos. A-365 and C-511 according to Resolution 3-2009 on February 3, 2009; and
WHEREAS, the Town Council adopted a resolution of local support for the project and
provided assurance the Town will complete the project according to Resolution 4-2009 on
February 17, 2009; and
WHEREAS, funding for the project has been appropriated in the adopted Capital
Improvement Program for CIP Nos. A-365 and C-511; and
WHEREAS, the California Department of Transportation, as administrators of funding from
the ARRA program, found the project to be categorically excluded with respect to the
National Environmental Policy Act, and have authorized the Town to proceed with
construction in accordance with all state and federal requirements; and
WHEREAS, the City Clerk of this Town did, in open session on the 18th day of August 2009
publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, after carefully considering, but subsequently dismissing, a bid protest
submitted by Granite Construction Company, the responsive low bidder is MCK Services
Inc. of Concord, CA, and the City Engineer has recommended awarding a contract for the
project to said firm; now, therefore, be it
RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is
authorized to execute, on behalf of the Town, a written contract with MCK Services Inc. for
$807,142.25 plus a 10% contingency of $80,714.23 for a total construction budget of
$887,856.48 for work in connection therewith, and the City Clerk is hereby directed to attest
same and affix thereto the official seal of the Town; and, be it further
RESOLVED, that the City Clerk shall within five (5) days of the adoption of this resolution,
transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.o. Box 603, San Francisco, CA 94101.
(Note: Should a finding of any discrepancy regarding this ratio of apprentices to journeymen
be made, the Town shall notify the Division of Apprenticeship Standards of such findings.)
