HomeMy WebLinkAbout2009-06 ORDINANCE NO. 2009-06 ADDING A NEW SECTION 5-8.13 TO THE DANVILLE MUNICIPAL CODE ESTABLISHING REQUIREMENTS FOR STATE LICENSED MASSAGE THERAPISTS The Danville Town Council does ordain as follows: SECTION 1. A new Section 5-8.13 is hereby added to the Danville Municipal Code to read as follows: 5-8.13 Requirements for State Certificate Holders. a. The permit requirements of this Section 5-8 shall not apply to the following persons: 1. any individual with a current, valid, current certificate issued by the California Massage Therapy Organization to practice as a massage therapist or massage practitioner as defined in Business and Professions Code Section 4600. 2. any massage establishment or business as defined. in Business and Professions Code Section 4612(b)(1). 3. Individuals or businesses as described in (1) and (2) above shall collectively be referred to as State Certificate Holders. b. Every individual State Certificate Holder shall register with the Danville Police Department at least two weeks prior to providing any massage services within the Town. The registration shall include the following information: the State Certificate Holder's name, address, telephone number, place(s) of employment, whether the individual intends to engage in outcall massage and a copy of the State Certificate. The Certificate Holder shall notify the Danville Police Department of any changes in the required information within 30 days of any change. c. Every massage establishment or business operating as a State Certificate Holder shall register with the Danville Police Department at least two weeks prior to providing any massage services within the Town. The registration shall include the following information: the name under which the business will operate, the address and telephone number of the business, whether the business intends to engage in outcall massage and copies of State Certificates for all individuals providing massage services. The Certificate Holder shall notify the Danville Police Department of any changes in the required information within 30 days of any change. d. All State Certificate Holders must obtain a Town Business License, must comply with all applicable zoning and building standards and shall comply with all other requirements of this Section 5.8 other than licensing requirements. SECTION 2. CODIFICATION. Section 1 of this ordinance shall be codified in the Danville Municipal Code. SECTION 3. SEVERABILITY. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of the ordinance. The Danville Town Council hereby declares that they would have adopted the ordinance, and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that one or more sections, subsections, sentences, clauses or phrases was declared invalid. SECTION 4. PUBLICATION AND EFFECTIVE DATE. The City Clerk shall have a summary of this ordinance published twice in a newspaper of general circulation, once within five (5) days before its adoption and once within 15 (fifteen) days after adoption. This ordinance shall become effective 30 days after adoption.
