RESOLUTION NO. 46-2009
AWARDING A CONSTRUCTION CONTRACT FOR THE STONE VALLEY ROAD
AND GREEN V ALLEY ROAD SIGNAL INTERCONNECT PROJECT,
CONTRACT NO. C-046
WHEREAS, the Danville Town Council approved the call for bids for the installation of
traffic signal interconnect along Stone Valley Road and Green Valley Road, Contract No.
C-046; and
WHEREAS, this is a Capital Improvement Project with funds being appropriated by the
Measure C Return to Source funds; and
WHEREAS, the City Clerk of this Town did, in open session on the 12th day of May, 2009,
publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, the low bidder is Brown and Fesler, Inc. of Livermore, and the City Engineer
has recommended awarding a contract for the project to said firm; now, therefore, be it
RESOLVED, by the Danville Town Council that the Town award the construction contract
for the installation of traffic signal interconnect along Stone Valley Road and Green Valley
Road, Contract No. C-046, to Brown and Fesler, Inc. of Livermore; and, be it further
RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is
authorized to execute, on behalf of the Town, a written contract with Brown and Fesler,
Inc. for $61,395.50, plus a 15% construction contingency of $9,209.33 for a total of $70,604.83
for work in connection with the installation of traffic signal interconnect along Stone Valley
Road and Green Valley Road, Contract No. C-046, in the form as lodged with the City
Clerk, together with such changes as may hereafter be determined necessary, provided
such changes do not materially increase the obligations to the Town hereunder, and to
receive and approve all bonds in connection therewith, and the City Clerk is hereby
directed to attest same and affix thereto the official seal of the Town; and, be it further
RESOLVED, that the City Clerk shall within five (5) days of the adoption of this resolution,
transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101.
(Note: Should a finding of any discrepancy regarding this ratio of apprentices to
journeymen be made, the Town shall notify the Division of Apprenticeship Standards of
such findings.).

following vote:
