RESOLUTION NO. 17-2009
ACCEPTING A GRANT OF PEDESTRIAN EASEMENT AT 404 HARTZ AVENUE
(MASON PROPERTIES, LLC)
WHEREAS, on May 16, 2006, the Town approved historic preservation incentives for
404 Hartz Avenue; and
WHEREAS, the incentives required the property owner to grant a pedestrian easement to
the Town across 404 Hartz Avenue for public access between the Front Street Municipal
Parking Lot and Hartz Avenue; and
WHEREAS, Mason Properties, LLC, has executed a Grant of Pedestrian Easement for
acceptance by the Town in conformance with the incentives; now, therefore, be it
RESOLVED, by the Danville Town Council that the City Clerk is hereby authorized and
directed to execute a Certificate of Acceptance to be attached to said Grant of Pedestrian
Easement; and, be it, further
RESOLVED, that the City Clerk is hereby directed to file with the County Recorder of the
County of Contra Costa, said Grant of Pedestrian Easement with attached Certificate of
Acceptance on behalf of the Town.

following vote:
