WEIR I Clerk-Recorder 00 DOC- 2008-0254519- ~ Recorded at request of: Town of Danville When recorded, mail to: Town of Danville City Clerk 510 LaGonda Way Danville, CA 94526-1740 Cheek Number Friday, NOV 21, FRE $0.00:: ltl Pd $0.00 2008 13:23:06 Nbr-0004263265 ka-t:/R6/1-2 RESOLUTION NO. 128-2008 APPROVING THE SUBDIVISION MAP FOR MS 851-2003, LOCATED AT 1591 LAWRENCE ROAD, AND ACCEPTING OFFERS OF DEDICATION WHEREAS, Golden Buffalo LLC, subdivider of said subdivision, has requested the Town of Danville approve said Subdivision Map for MS 851-2003, located at 1591 Lawrence Road; and WHEREAS, the Subdivision Map complies with standards set forth in the California Subdivision Map Act and Danville Municipal Code; and WHEREAS, subdivider has complied with all Conditions of Approval established by the Town of Danville for the subject subdivision; and WHEREAS, said subdivision lies within the corporate limits of the Town of Danville; and WHEREAS, this Subdivision Map is consistent with the Town1s General Plan; and WHEREAS, the subdivider has requested the Town of Danville accept said subdivision improvements as complete and accept the dedications offered to the Town of Danville on said subdivision map of MS 851-2003; and WHEREAS, the City Engineer has advised that the improvements required as a condition of the subdivision between the Town of Danville and said subdivider have been satisfactorily completed; and WHEREAS, it is now in the interest of the Town of Danville to: 1. accept those dedications of public streets and other easements on said subdivision map for the benefit and use of the general public; and 2. accept those public improvements installed as public facilities for the benefit and use of the general public; and WHEREAS, the Danville Town Council must act affirmatively in order for the subdivision improvements and dedications to be accepted; now, therefore, be it RESOLVED, that the Danville Town Council accepts the following dedications offered for the public benefit within this subdivision: 1. Emergency Vehicle Access Easement (E.V.A.E.) across the private roadway; 2. Pedestrian Trial Easement across the Lawrence Road frontage and across the eastern side of Alamo Creek; 3. Public Utility Easement (P.U.E.) across the Lawrence Road frontage; and 4. Structure Setback Easement (S.5.B.E.) across both western and eastern sides of Alamo Creek; and, be it further RESOLVED, that the Town of Danville hereby accepts those public improvements installed as a condition of this subdivision; and, be it further RESOLVED, that the Subdivision Map is hereby approved and Town staff is authorized and directed to execute the same on behalf of the Town.
