RESOLUTION NO. 88-2008
APPROVING THE JOINT USE AND MAINTENANCE AGREEMENT
FOR THE DANVILLE VETERANS MEMORIAL BUILDING
WHEREAS, it is the intention of Contra Costa County to transfer its ownership of the
Danville Veterans Memorial Building, located at 400 Hartz Avenue Danville, CA, to the
Town of Danville; and
WHEREAS, the Town intends to replace, renovate, or renovate and expand the
Danville Veterans Memorial Building to address and mitigate currently identified
building deficiencies, adequately address veterans' needs, and allow for other
community use including, but not limited to, senior programs, recreational activities,
social events, and community rentals, in such a way as to not unduly interfere with the
reasonable use of the Building by veterans; and
WHEREAS, before the County conveys title to the aforementioned property to the
Town, it is required that the Town and the Danville Veterans Memorial Building Board
of Trustees execute a mutually acceptable lease agreement setting forth all terms and
conditions related to the occupancy, use, maintenance and operation of the new or
renovated building; and
WHEREAS, the Town will continue to lease the Danville Veterans Memorial Building
primarily for the use and benefit of Veterans' associations in accordance with the
Military and Veterans Code Section 126, et. seq.; and
WHEREAS, on July 8, 2008, the Danville Veterans Memorial Board of Trustees
approved the Joint Use and Maintenance Agreement which will commence upon
occupancy of the new or renovated building; now, therefore, be it
RESOLVED, by the Danville Town Council that the Town Manager is hereby
authorized to execute, on behalf of the Town, a Joint Use and Maintenance Agreement
for the Danville Veterans Memorial Building.
APPROVED by the Danville Town Council at a regular meeting on July 15, 2008 by the
following vote:
AYES: Andersen, Doyle, Shimansky, Stepper
