HomeMy WebLinkAbout056-08 RESOLUTION NO. 56-2008 AWARDING A CONSTRUCTION CONTRACT AND APPROPRIATING ADDITIONAL FUNDS FOR THE PARKING LOT MAINTENANCE AT EAST BAY FELLOWSHIP CHURCH, CIP NO. A-271 WHEREAS, the Danville Town Council approved a call for bids for the Parking Lot Maintenance at East Bay Fellowship Church, CIP No. A-271, Resolution No. 20-2008; and WHEREAS, the Town entered into an agreement with East Bay Fellowship Church on April 1, 2008, via Resolution 27-2008 that obligates the church to convey land to the Town . for Sycamore Valley Park in exchange for improvements to the church parking lot, and that obligates the Town to perform limited future maintenance of the improvements; and WHEREAS, the City Clerk of this Town did, in open session on the 6th day of May, 2008, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, the lowest responsive bidder is William G. McCullough Company of Antioch, California, and the City Engineer has recommended awarding a contract for the project to said firm; and WHEREAS, the bids received from Elite Landscaping, Grade Tech, Inc., Redgwick Construction, Tri-Valley Excavating, and Sonoma Engineering were deemed non- responsive for failing to comply with required contract provisions; and WHEREAS, funding for the project has been appropriated in the 2007/08 through 2011/12 Capital Improvement Program; and WHEREAS, an additional appropriation from General Purpose Revenue in the amount of $287,893 is needed to fully fund the project; now, therefore, be it RESOLVED, by the Danville Town Council, that the Town award a construction contract for the Parking Lot Maintenance at East Bay Fellowship Church to William G. McCullough Company of Antioch, California; and, be it further RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is authorized to execute, on behalf of the Town, a written contract with William G. McCullough Company for $979,629.50 plus a 10% construction contingency of $97,963 for a total construction budget of $1,077,593 for work in connection therewith, and the City Clerk is hereby directed to attest same and affix thereto the official seal of the Town; and, be it further RESOLVED, by the Danville Town Council, that an additional $287,893 be appropriated from General Purpose Revenue to fully fund the project; and, be it further RESOLVED, that the City Clerk shall within five (5) days of the adoption of this resolution, transmit an Extract of Public Works contract award to the Department of Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101. (N ote: Should a finding of any discrepancy regarding this ratio of apprentices to journeymen be made, the Town shall notify the Division of Apprenticeship Standards of such findings.) .
