HomeMy WebLinkAbout023-08 RESOLUTION NO. 23-2008 AWARDING A CONSTRUCTION CONTRACT FOR THE HAP MAGEE PARKING AND STAGING AREA PROJECT, CIP NO. B-451, AND FINDING SAID PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, the Danville Town Council approved a call for bids for the Hap Magee Parking and Staging Area Project, CIP No. B-451, as Resolution No. 75-2007; and WHEREAS, the City Clerk of this Town did, in open session on March 4,2008, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, after carefully considering, but subsequently dismissing, a bid protest by Gordon N. Ball, Inc., the lowest responsive bidder is Alaniz Construction, Inc. of Fremont, California, and the City Engineer has recommended awarding a construction contract for the project to said contractor; and WHEREAS, funding for the project has been appropriated in the 2007/08 through 2011/12 Capital Improvement Program; and WHEREAS, the project has been found to be Categorically Exempt for the provisions of the California Environmental Quality Act (CEQA) according to 915311 of the CEQA Guidelines; now, therefore, be it RESOLVED, by the Danville Town Council, that the Town award a construction contract for the Hap Magee Parking and Staging Area Project to Alaniz Construction, Inc. of Fremont, California; and, be it further RESOL VED, by the Danville Town Council, that the Town Manager be and hereby is authorized to execute, on behalf of the Town, a written contract with Alaniz Construction, Inc. for $493,507 and a 10% construction contingency of $49,351 for a total of $542,858 for work in connection therewith, and the City Clerk is hereby directed to attest same and affix thereto the official seal of the Town; and, be it further RESOLVED, that the City Clerk shall within five (5) days of the adoption of this resolution, transmit an Extract of Public Works contract award to the Department of Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to journeymen be made, the Town shall notify the Division of Apprenticeship Standards of such findings.); and, be it further RESOLVED, that the Town of Danville hereby finds the Hap Magee Parking and Staging Area Project to be categorically exempt from CEQA according to Guidelines Section 15311; and, be it further RESOL VED, that the Town of Danville shall file a Notice of Exemption with the Contra Costa County Clerk in accordance with CEQA to publicly disclose this finding.
