HomeMy WebLinkAbout012-08 RESOLUTION NO. 12-2008 ADOPTING A NOTICE OF CATEGORICAL EXEMPTION FOR THE SYCAMORE V ALLEY ROAD IMPROVEMENTS PROJECTS CIP NOS. C-486 AND C-487 WHEREAS, the Town of Danville has an adopted Capital Improvement Program (CIP) for the years 2007/2008 through 2011/2012, in which a comprehensive plan for capital improvement projects and associated fundings are identified; and WHEREAS, the CIP identifies the Sycamore Valley Road Improvements Projects as Transportation Improvements Projects under CIP No. C-486 and C-487, with the necessary funding from the Commercial Transportation Impact Program, Residential Transportation Impact Program, and Measure C Strategic Plan; and WHEREAS, all public agencies are required to evaluate their projects that have the potential to affect the environment within the purview of the California Environmental Quality Act (CEQA); and WHEREAS, Section 21084 of the Public Resources Code requires CEQA guidelines for class of projects which have been determined not to have a significant effect on the environment and which shall, therefore, be exempt from the provisions of CEQA; and WHEREAS, the Town of Danville performed the necessary environmental analysis to determine that Projects C-486 and C-487 are categorically exempt from CEQA under Article 19., Guidelines Section 15301; and WHEREAS, the Town made this determination after finding that the improvement projects would require minor alterations of existing roadway facilities to alleviate existing traffic congestion, and that the projects will involve negligible or no expansion of use beyond that existing at the time of this determination; now, therefore, be it RESOLVED, that the Town of Danville hereby finds the Sycamore Valley Road Improvements Projects to be categorically exempt from CEQA according to Guidelines Section 15301; and, be it further ' RESOLVED, that the Town of Danville shall file a Notice of Exemption with the Contra Costa County Clerk in accordance with CEQA to publicly disclose this finding.
