RESOLUTION NO. 9-2008
AWARDING A CONSTRUCTION CONTRACT FOR THE SYCAMORE V ALLEY
AND DIABLO VISTA PARKS PLAY AREA RENOVATION, PROJECT B-449, AND
BOCCE SHADE STRUCTURES AND GROUP PICNIC AREA, PROJECT B-489
WHEREAS, the Danville Town Council approved a call for bids for the construction of the
Sycamore Valley and Diablo Vista Parks Play Area Renovation, Project B-449, and Bocce
Shade Structures and Group Picnic Area, Project B-489; and
WHEREAS, the Danville City Clerk did, in open session on January 22, 2008 at 2:00 p.m.,
publicly open and read aloud 11 sealed bids received as required by law; and
WHEREAS, the lowest responsive bidder is American Civil Constructors, Inc. of Martinez,
CA) and the City Engineer has recommended awarding a construction contract for the
project to said contractor; and
WHEREAS, funds are available for the Sycamore Valley and Diablo Vista Parks Play Area
Renovation, Project B-449, and Bocce Shade Structures and Group Picnic Area, Project
B-489 in the Town's Five-Year Capital Improvement Program; now, therefore, be it
RESOLVED, by the Danville Town Council that the Town Manager is hereby authorized
to execute, on behalf of the Town, a written contract with American Civil Constructors,
Inc., in the amount of $941,750.25, plus a contingency of $94,175.03 as needed, for a total of
$1,035,925.28 for construction of the Sycamore Valley and Diablo Vista Parks Play Area
Renovation, Project B-449, and Bocce Shade Structures and Group Picnic Area, Project
B-489, in the form lodged with the City Clerk, together with such changes as may hereafter
become necessary, provided such changes do not materially increase the obligations to the
Town; and, be it further
RESOLVED, that the City Clerk shall within five (5) days of the adoption of this resolution,
transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101.
(Note: Should a finding of any discrepancy regarding this ratio of apprentices to
journeymen be made, the Town shall notify the Division of Apprenticeship Standards of
such findings.)
