RESOLUTION NO. 141-2007
APPROPRIATING ADDITIONAL FUNDS AND AUTHORIZING EXECUTION OF
AN AMENDED AGREEMENT FOR ENVIRONMENTAL CONSULTING
SERVICES FOR THE PREPARATION OF AN ENVIRONMENTAL
IMPACT REPORT ASSOCIATED WITH THE ELWORTHY
WEST DEVELOPMENT APPLICATION
(ELWORTHY WEST, LLC)
WHEREAS, the Town of Danville has received a Preliminary Development Plan -
Rezoning (PUD 2005-02) and Final Development Plan - Major Subdivision (SD 9009)
request by Elworthy West, LLC to allow 84 single family homes and 12 apartment units
on a 458 + j - acre site; and
WHEREAS, the subject site is located on the west side of Highway 680, on the hillside
between Midland Way and Fountain Springs Circle and is further identified as
Assessor's Parcel Numbers 208-230-020, 021, 030, 031, 032, 033; and
WHEREAS, the Town's initial review of the proposed development identified
potentially significant environmental impacts to be associated with the project; and
WHEREAS, pursuant with the requirements of the California Environmental Quality
Act (CEQA), in order to study and disclose all potentially significant environmental
impacts associated with the project, an Environmental Impact Report (EIR) must be
prepared; and
WHEREAS, after soliciting proposals from qualified environmental consulting firms,
on June 7, 2007, the Danville Town Council adopted Resolution No. 67-2006
appropriating funds provided by the applicant and approving a contract agreement
between the Town of Danville and RBF Consulting; and
WHEREAS, as a result of a budget over-run which can be attributed to changes to the
project that have occurred during preparation of the EIR, including the incorporation of
an equestrian facility, that have required the consultant to go back through the
document to make revisions and ensure consistency. In some cases, sections had to be
re-written, requiring an additional $7,200.00 to complete the EIR; now, therefore, be it
RESOLVED, that the Danville Town Council authorizes the Danville Town Manager to
execute an amended agreement with RBF Consulting Inc. for the preparation of an EIR
associated with the Elworthy West development application; and, be it further
RESOLVED, that an additional $7,200.00 to complete the EIR is appropriated from
funds provided by the applicant for the cost of preparing the Environmental Impact
Report.
