RESOLUTION NO. 80-2007
AWARDING A CONSTRUCTION CONTRACT FOR THE
DIABLO/HARTZ SIDEWALK REPAIR, CIP NO. A-456; WEST LINDA MESA
AVENUE DRAINAGE IMPROVEMENTS, CIP NOS. A-362 AND A-330; AND
APPIAN COURT DRAINAGE IMPROVEMENTS, CIP NO. A-330
WHEREAS, the Danville Town Council approved a call for bids for the construction of the
Diablo/Hartz Sidewalk Repair project, CIP No. A-456; and drainage repair work at 120
West Linda Mesa Avenue, a portion of the Downtown Improvement Project, CIP No.
A-362, via Resolution No. 68-2007; and
WHEREAS, the City Clerk of this Town did, in open session on July 31, 2007, at 2:00 p.m.,
publicly open and read aloud six sealed bids received as required by law; and
WHEREAS, the City Clerk of this Town did, in the presence of the City Attorney on
August I, 2007, open one additional sealed bid, which was received and date-stamped at
12:15 p.m. on July 31, 2007; and
WHEREAS, the lowest responsive bidder is Acequia Cement of Fairfield, California, and
the City Engineer has recommended awarding a construction contract for the project to
said contractor; and
WHEREAS, funding for the project has been appropriated in the 2007/08 through 2011 /12
Capital Improvement Program; now, therefore, be it
RESOLVED, by the Danville Town Council, that the Town award a construction contract
for the Diablo/Hartz Sidewalk Repair; West Linda Mesa Avenue Drainage
Improvements; and Appian Court Drainage Improvements to Acequia Cement of
Fairfield, California; and, be it further
RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is
authorized to execute, on behalf of the Town, a written contract with Acequia Cement for
$77,140 and a 15% construction contingency of $11,571 for a total of $88,711 for work in
connection therewith, and the City Clerk is hereby directed to attest same and affix thereto
the official seal of the Town; and, be it, further
RESOLVED, that the City Clerk shall within five (5) days of the adoption of this resolution,
transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.o. Box 603, San Francisco, CA 94101.
(Note: Should a finding of any discrepancy regarding this ratio of apprentices to
journeymen be made, the Town shall notify the Division of Apprenticeship Standards of
such findings.)

following vote:
