RESOLUTION NO. 54-2007
FINDING THE WOODBINE PEDESTRIANfBICYCLE BRIDGE REPLACEMENT
PROJECT, CIP NO. B-120, CATEGORICALLY EXEMPT FROM CEQA
WHEREAS, Article 3 of the Transportation Development Act (TDA), Public Utilities Code
(PUC) Section 99200 et seq., authorizes the submission of claims to a regional
transportation planning agency for the funding of projects exclusively for the benefit
and/ or use of pedestrians and bicyclists; and
WHEREAS, the Metropolitan Transportation Commission (MTC), as the regional
transportation planning agency for the San Francisco Bay region, has adopted MTC
Resolution No. 875, Revised, entitled "Transportation Development Act, Article 3,
Pedestrian/Bicycle Projects," which delineates procedures and criteria for submission of
requests for the allocation of "TDA Article 3" funding; and
WHEREAS, said resolution requires allocation requests to be accompanied by certified
environmental documents prepared in accordance with the California Environmental
Quality Act (CEQA); and
WHEREAS, the Town of Danville submitted an application for allocation of TDA Article 3
funding to replace the Woodbine Pedestrian/ Bicycle Bridge located on Green Valley Creek
behind the Green Valley Shopping Center on Diablo Road; and
WHEREAS, the Town of Danville performed an environmental analysis of the proposed
bridge replacement project, included as Project B-120 in the Town's adopted Capital
Improvement Program, and found the project to be categorically exempt from CEQA
according to Guidelines Section 15302; and
WHEREAS, the Town made this determination after finding that the replacement bridge
will be located on the same site as the original, and that the replacement bridge will have
substantially the same purpose and capacity; now, therefore, be it
RESOLVED, that the Town of Danville hereby finds the Woodbine Pedestrian/Bicycle
Bridge Replacement Project to be categorically exempt from CEQA according to Guidelines
Section 15302; and, be it further
RESOLVED, that the Town of Danville shall file a Notice of Exemption with the Contra
Costa County Clerk in accordance with CEQA to publicly disclose this finding.
