RESOLUTION NO. 24-2007
AUTHORIZING THE TOWN COUNCIL TO ACCEPT THE GRANT OF EASEMENT
FOR A PEDESTRIAN TRAIL AND CREEK MAINTENANCE EASEMENT
ASSOCIATED WITH THE DANVILLE MINI STORAGE IMPROVEMENTS
LOCATED AT 3550 CAMINO T ASSAJARA
WHEREAS, Condition of Approval G.10 of Development Plan DP-10 and Minor
Subdivision MS 855-96 as approved by the Planning Commission on July 19, 1996, required
the applicant to dedicate a public easement across the applicant's property; and
WHEREAS, John Wright, the applicant for said Danville Mini Storage development located
at 3550 Camino Tassajara, constructed improvements along the south bank of Alamo
Creek including a pedestrian trail; and
WHEREAS, the pedestrian trail and adjacent creek is within the Town of Danville and is
maintained by the Town; and
WHEREAS, Minor Subdivision MS 855-96 was never recorded and therefore Condition of
Approval G.10 was never satisfied; and
WHEREAS, the applicant has now executed a Grant of Easement for a "Pedestrian Trail
and Creek Maintenance Easement" for acceptance by the Town to satisfy the condition of
approval; now, therefore, be it
RESOLVED, by the Danville Town Council, that the Town hereby accepts the Grant of
Easement for the Pedestrian Trail and Creek Maintenance Easement and directs the City
Clerk to execute the Certificate of Acceptance and to have the deed recorded with the
Contra Costa County Recorder.
