HomeMy WebLinkAbout060-06 RESOLUTION NO. 60-2006 APPROVING HISTORIC PRESERVATION INCENTIVES FOR 404 HARTZ AVENUE (APN: 208-022-014) WHEREAS, Mason Properties LLC is the owner of the subject property located at 404 Hartz Ave; and WHEREAS, Chapter 32-72 of the Danville Municipal Code (Historic Preservation) requires the Heritage Resource Commission review and recommend a historic preservation incentives for Town Council approval; and WHEREAS, the Planning Commission and Heritage Resource Commission jointly approved a Development Plan and Variance that includes construction of a detached, two-story 3,966 + / - square foot addition; WHEREAS, the Town Council designated the property as a Heritage Resource on April 15,2003 and executed a Mills Act Contract on May 18, 2004; now, therefore, be it RESOLVED, that the Danville Town Council approves historic preservation incentives for 404 Hartz Ave that includes the following: 1. Expands the range of allowable uses that may occupy the second floor of the addition to include residential use and office use for the ground floor; 2. Waives the parking in-lieu fees for seven (7) parking spaces (equaling approximately $49,000); 3. Conditional waiver of parking fees for the remaining seven (7) spaces (equaling approximately $49,000) should one or both of the following occur: (a) the new ground floor space is leased to a retail tenant and/ or (b) a minimum 5' wide public pedestrian access easement along the northwest property line, allowing pedestrians to access the Municipal Front Street parking lot from Hartz Avenue, is dedicated to the Town; 4. Commits the Town to assist the property owner in any efforts they undertake to obtain Federal and/ or State historic preservation grants and aid; 5. Waives Transportation Improvement Program (TIP) fees ($4.50 for 3,966 sq.ft. of conditioned space equaling $17,847); 6. Authorizes application of the provisions of the Historic Building Code to the historic structure; 7. Waives all Planning application fees (equaling approximately $4,054); 8. Waives all Building Inspection (except plan check fees), child care, stormwater, Engineering and Planning fees associated with the issuance of building permits (equaling approximately $5,039); and 9. Includes the site in all marketing plans and public information brochures developed to increase the public's awareness of the Town's Historic Preservation Program.
