RESOLUTION NO. 59-2006
APPROVING HERITAGE RESOURCE DESIGNATION OF
THE HISTORIC McDONALD'S DRUG STORE AND
GRANTING HISTORIC PRESERV A TION INCENTIVES
FOR 345 AND 349 HARTZ AVENUE
(APN: 199-350-013)
WHEREAS, Blue Sun Corporation is the owner of the subject property located at 345
and 349 Hartz Ave; and
WHEREAS, the property owner is concurrently requesting Heritage Resource
designation for the subject property and approval of historic preservation incentives
associated with this designation; and
WHEREAS, Chapter 32-72 of the Danville Municipal Code (Historic Preservation)
requires the Heritage Resource Commission review and recommend Heritage Resource
designation and preservation incentives for Town Council approval; and
WHEREAS, on April 25, 2006, the Planning Commission and Heritage Resource
Commission jointly approved a Development Plan and. Variance that includes the
construction of a two story 3,759 + / - square foot addition with a visual orientation
toward Railroad Avenue; and
WHEREAS, on April 25, 2006, the Heritage Resource Commission adopted Resolutions
No. 2006-04 and No. 2006-05 recommending the Town Council approve Heritage
Resource designation and historic preservation incentives for 345 and 349 Hartz
A venue; and
WHEREAS, the history of the building is as follows:
1. C. Randolf Hook, a local commercial builder, built the 3,592 + / - sq. ft. building in
1922 for $10,000.
2. The two story brick building architectural style is Spanish Eclectic Revival.
3. In 1922, there was a drugstore and ice cream parlor on the first floor with an
apartment upstairs where the McDonald family lived.
4. The historic name for the site is McDonald's Drug Store.
5. Exterior modifications have been made to the brick fa<;ade and north (side)
elevation of the building.
6. The property was placed on the Town's Survey of Historically Significant Resources
on October 8, 2001.
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, a staff report was submitted recommending that the Town Council
approve the request; and
WHEREAS, the Town Council did hear and consider all reports, recommendations, and
testimony in writing and presented at the hearing; now, therefore, be it
RESOLVED the Danville Town Council approves Heritage Resource Designation of the
historic McDonald's Drug Store and grants the following historic preservation
incentives for 345 and 349 Hartz Avenue, based on the following findings and Historic
Preservation Ordinance criteria:
Designation:
1. The existing structure was built on the site in 1922 and is over fifty years old.
2. The structure has retained its historic integrity and has been well maintained.
Although the building has had modifications made over time, much of the
original historic architectural detailing and materials have been retained and the
changes are reversible.
3. Criteria a: The building's Spanish Eclectic Revival style of architecture is
representative of the time period in which it was built and is the only historic
commercial building of this style still remaining in Danville.
4. Criteria band c: It represents an important use to the community that was once
common but is now rare since there are few businesses in downtown commercial
districts where the owner resides upstairs.
5. Criteria d: C. Randolf Hook was a notable local e,:ommercial builder who built
the building in 1922.
6. Criteria g: The structure is one of the few historic brick buildings still remaining
in downtown Danville. The second story brick fa<;ade is original and contains
fine brick detailing and craftsmanship. The north elevation arches (which were
added for building stabilization) are also unique in design and appearance.
7. Criteria hand i: The structure is located on the main street in the heart of old
town Danville and has become an established visual feature of the community.

Historic preservation incentives:
1. Expands the range of allowable uses that may occupy the second floor of both the
historic structure and the new addition to include residential uses;
2. Waives the parking in-lieu fees for six parking spaces (fee Waiver equaling
approximately $21,000) for the new ground floor retail space;
3. Defers or waives payment of the parking in-lieu fees for an additional eight parking
spaces (fee waiver equaling approximately $56,000) for the new second floor office
space, depending on land uses of the historic building. Typically, the parking in-lieu
fees are due prior to final Planning Division sign-off of the building permit. If the
ground floor tenant space in the historic building converts to a retail land use prior
to tenant occupancy of the addition, the parking in-lieu fees for the additional eight
parking spaces would be waived, subject to Conditions of Approval D.l, D.2 and
D.3 for DP 2005-24 per Heritage Resource Commission Resolution 2006-03. At the
discretion of the Town, payment of the parking in-lieu fees may be deferred after
tenant occupancy of the addition, if it is satisfactorily documented that the owners
anticipate a new retail land use for the historic building. If the land use changes to
retail for the historic building at anytime after the owner has already paid the
parking in-lieu fees, the paid fees will be refunded to the owner;
4. Commits the Town to assist the property owner in any efforts they undertake to
obtain Federal and/ or State historic preservation grants and aid;
5. Authorizes the Town Manager, on behalf of the Town, to enter into and execute a
Mills Act Contract with the property owner, potentially providing for a reduction in
property taxes associated with the historic structure;
6. Waives Transportation Improvement Program (TIP) fees fee waiver equaling
approximately $16,915);
7. Authorizes application of the provisions of the Historic Building Code to the historic
structure;
8. Waives all Planning application fees (equaling approximately $4,054);
9. Waives building inspection fees (plan check fees are not waived) and waives child
care and stormwater fees and Engineering and Planning Division plan check and
inspection fees associated with the new building addition (fee waiver equaling
approximately $5,852);
10. Provides a Heritage Resource identification plaque for the site; and
11. Includes the site in all marketing plans and public information brochures developed
to increase the public's awareness of the Town's Historic Preservation Program.
