HomeMy WebLinkAbout058-06 RESOLUTION NO. 58-2006 AUTHORIZING AMENDED ENCROACHMENT PERMITjRIGHT-OF-ENTRY AND OPERATING AGREEMENTS WITH THE PACIFIC COAST FARMERS' MARKET ASSOCIATION WHEREAS, the Town of Danville has hosted a Certified Farmers' Market in its Old Town business district for the past sixteen years; and WHEREAS, the current operator of the Farmers' Market, the Pacific Coast Farmers' Market Association (PCFMA), holds an Encroachment PermitjRight-of-Entry to use a portion of the Railroad Avenue Municipal Lot on Saturdays as authorized by the Town of Danville; and WHEREAS, the Town of Danville and PCFMA have an Operating Agreement for the Saturday market; and WHEREAS, the community and surrounding areas benefit from the availability of farm fresh produce; and WHEREAS, downtown businesses benefit from additional shoppers attracted by the market; now, therefore, be it RESOLVED that the encroachment permitjright-of-entry and operating agreements be amended to include language authorizing a seasonal Thursday night market; and be it RESOLVED that the Operating Agreement be amended to include juices and flavored nuts in the Processed Agriculture category, and ethnic foods, kettle corn and soap in the Non- Agriculture category, and that the percentage of non-agriculture goods be adjusted from 25% to 30% of the total on Saturdays, and 35% percent of the total on Thursday nights, with a restriction placed on this increased percentage increment to allow only local Danville food purveyors or producers; and be it RESOLVED that the Encroachment PermitjRight-of-Entry be amended to close a portion of the Railroad Avenue parking lot each Saturday from 7:00 a.m. to 2:00 p.m. year-round and from 1:00 p.m. to 9:00 p.m. on Thursdays from April 1st to September 30th for the operation of the Certified Farmers' Market; and be it FURTHER RESOLVED that the Mayor be, and hereby is, authorized to execute the amended Encroachment PermitjRight-of-Entry and Operating Agreements with the Pacific Coast Farmers' Market Association in the form as lodged with the City Clerk, together with such changes as hereafter may become necessary, provided that such changes do not materially increase the obligations of the Town thereunder.
