HomeMy WebLinkAbout055-06 RESOLUTION NO. 55-2006 SUMMARILY VACATING A PORTION OF PUBLIC STREET RIGHT-OF-WAY AT THE END OF CULET RANCH ROAD WHEREAS, Culet Ranch Road is a public street within the Town of Danville formerly known as Casolyn Ranch Road, as originally dedicated to the County of Contra Costa on September 15, 1977 in book 8505, page 388, of official records, as a right-of-way easement; and WHEREAS, Shwu Rong Lee owns fee title to the property located at 1240 Culet Ranch Road; and WHEREAS, the owner received approval from the Town Council on November 4, 2003, to subdivide the property into five- single family residential lots as SD 8652; and WHEREAS, the approved tentative map anticipated a future abandonment of right-of-way for a portion of the cul-de-sac bulb at the end of Culet Ranch Road that encumbers Lot 5; and WHEREAS, said portion of cul-de-sac bulb to be abandoned is not needed because a cul- de-sac was built with a different alignment; and WHEREAS, Part 3, Chapter 4 of the California Street and Highways Code (Section 8330 et seq.) provides for the summary vacation of street easements under specified circumstances; and WHEREAS, the Town desires to use this statutory authority to abandon a portion of Culet Ranch Road; now, therefore, be it RESOLVED, by the Danville Town Council, that 1. The Town of Danville hereby summarily vacates that portion of street easement of Culet Ranch Road fronting 1240 Culet Ranch Road as shown on the attached Quitclaim Deed (Exhibit 1), which is incorporated herein by this reference. 2. This summary vacation is made pursuant to the authority of Part 3, Chapter 4 of the California Streets and Highways Code, specifically Section 8330 (et seq.). This portion of street easement is excess and is not required for street purposes because for a period of five consecutive years the street has been impassable for vehicular travel and no public money was expended for maintenance, and no in-place public utility facilities exist that are in use that would be affected by the vacation. 3. The City Clerk is directed to record a certified copy of this resolution together with the Quitclaim Deed with the Contra Costa County Recorder's Office. 4. This vacation shall become effective upon recordation of the Quitclaim Deed.
