RESOLUTION NO. 45-2006
AUTHORIZING THE TOWN MANAGER TO EXECUTE A COOPERATIVE
AGREEMENT WITH THE NATURAL RESOURCES CONSERVATION SERVICE
FOR ASSISTANCE UNDER THEIR EMERGENCY WATERSHED PROTECTION
PROGRAM AND AUTHORIZING THE TOWN MANAGER TO ENTER INTO
AGREEMENTS WITH PRIVATE PROPERTY OWNERS ALLOWING FOR THEIR
PARTICIPATION IN THE PROGRAM
WHEREAS, the Natural Resources Conservation Service (NRCS), a division of the United
States Department of Agriculture, operates the Emergency Watershed Protection Program.
This program provides up to 75% of the costs to repair certain damage to private property
caused by flooding; and
WHEREAS, the program requires the local governmental agency to enter into a
Cooperative Agreement with the NRCS making the local agency the sponsor and agreeing
to contribute the remaining 25% of the cost of the repairs; and
WHEREAS, all of the costs of the local agency sponsor, including, but not limited to, costs
of design, engineering and actual repair, may be passed on by the local agency to the
private property owner whose property is being repaired; and
WHEREAS, Contra Costa County has successfully participated in this program at no cost
to taxpayers; now, therefore, be it
RESOLVED, by the Danville Town COJlncil, that the Town Manager is hereby authorized
to execute a Cooperative Agreement with the Natural Resources Conservation Service for
assistance under their Emergency Watershed Protection Program and to enter into
agreements with private property owners allowing for their participation in the program.
APPROVED by the Danville Town Council at a regular meeting on Apri118, 2006, by the
following vote:
