HomeMy WebLinkAbout146-05 RESOLUTION NO. 146-2005 AWARDING A CONSTRUCTION CONTRACT FOR THE INSTALLATION OF A MID-BLOCK CROSSWALK ON LA GONDA WAY, CONTRACT NO. C-305 WHEREAS, Goal 12 of the Town of Danville 2010 General Plan directs the Town to "Provide for safe and efficient travel on Town of Danville streets"; and WHEREAS, Policy 14.01 of the Town of Danville 2010 General Plan directs the Town to "Implement neighborhood traffic management measures, including physical changes and traffic control devices, which increase neighborhood livability and street ambiance, discourage through traffic on residential streets, discourage speeding, and ensure vehicle, pedestrian, and bicycle safety"; and WHEREAS, land uses along La Gonda Way (south of El Cerro Boulevard) have transitioned from being primarily residential to a more campus-like environment that now includes private institutional uses such as St. Isidore's Church, St. Isidore's School and Kids Konnection (affiliated with St. Isidore's School); and WHEREAS, the need for groups of school children to access the school facilities across La Gonda Way frequently during the course of a typical day resulted in a growing concern about prevailing speeds along the roadway and pedestrian crossing safety; and WHEREAS, the need for frequent pedestrian crossing is generated by these new private institutional uses and that it would be appropriate for the cost of the flashing beacons and mid-block crosswalk to be borne equally by the Town and St. Isidore's Church; and WHEREAS, St. Isidore's Church affirmed its commitment to fund 50% of the cost of the flashing beacons and mid-block crosswalk; and WHEREAS, the installation of a mid-block crosswalk, consisting of the installation of curb ramps and a textured asphalt crosswalk, is allowed by applicable State law regulating roadway design features; and WHEREAS, plans and specifications for the installation of a mid-block crosswalk on La Gonda Way are categorically exempt from the requirements of the California Environmental Quality Act, Section 15301, Class 1; and WHEREAS, 2005/06 funds have been appropriated for installation of traffic safety devices in Project C-305 of the 2005/06 to 2009/10 Five-Year Capital Improvement Program; and WHEREAS, the City Clerk of this Town did, in open session on the 8th day of December, 2005, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, the low bidder for the mid-block crosswalk project is AJW Construction of Oakland, CA and the City Engineer has recommended awarding a contract for the project to said firm; now, therefore, be it RESOLVED, by the Danville Town Council, that the: 1. Town of Danville award the construction contract for the installation of a mid-block crosswalk on La Gonda Way to AJW Construction of Oakland, CA; and 2. Town Manager be and is hereby authorized to execute, on behalf of the Town, a written contract with AJW Construction for $15,185 plus a 15% construction contingency of $2,278 for a total of $17,463 for work in connection therewith, and the City Clerk is hereby directed to attest same and affix thereto the official seal of the Town; and 3. City Clerk shall within five (5) days of the adoption of this resolution, transmit an Extract of Public Works contract award to the Department of Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to journeymen be made, the Town shall notify the Division of Apprenticeship Standards of such findings.); and, be it further resolved, that 4. Town of Danville is authorized to receive funds from St. Isidore's Church for an amount equivalent to 50% of the costs of: a. Two flashing overhead beacons (equipment and installation); and b. Mid-block textured crosswalk construction.
