RESOLUTION NO. 130-2005
AUTHORIZING THE TOWN MANAGER TO ACCEPT PUBLIC SIDEWALK
EASEMENTS ASSOCIATED WITH THE FRONT STREET MUNICIPAL
PARKING LOT, CONTRACT NO. C-481
WHEREAS, the Danville Town Council authorized the purchase of the property at
177 Front Street via Resolution No. 89-2004, and accepted the land via an Individual Grant
Deed recorded with the Contra Costa County Recorder as Document 2005-0322476-00 on
August 25, 2005; and
WHEREAS, the Town intends to demolish the existing building at 177 Front Street and
construct the Front Street Municipal Parking Lot in conformance with the Town's 2010
General Plan goals and policies; and
WHEREAS, the Danville Town Council approved inclusion of the parking lot project in the
Town's Capital Improvement Program, appropriated funds for design and construction,
and awarded a design contract via Resolution No. 3-2005; and
WHEREAS, the project relies on pedestrian access between the parking lot and the
downtown across private properties at 137 East Prospect Avenue and 432 Hartz Avenue as
owned by Pearson & Williams I, LLC, and Archangel Investments, LLC, respectively; and
WHEREAS, Pearson & Williams I, LLC, and Archangel Investments, LLC, have offered to
execute grant deeds for non-exclusive public sidewalk easements for acceptance by the
Town; now, therefore, be it
RESOLVED, by the Danville Town Council, that the Town hereby accepts public sidewalk
easements from Pearson & Williams I, LLC, (137 East Prospect Avenue) and Archangel
Investments, LLC, (432 Hartz Avenue) and directs the City Clerk to execute Certificates of
Acceptance and to have the deeds recorded with the Contra Costa County Recorder.
APPROVED by the Danville Town Council at a regular meeting on November 1, 2005, by
the following vote:
AYES: Doyle, Stepper, Andersen, Arnerich, Shimansky
