RESOLUTION NO. 129-2005
APPROVING PRESERVATION INCENTIVES FOR THE SHUEY/PODV A HOUSE
LOCATED AT 100 SCHOOL STREET
(APN: 208-025-001)
WHEREAS, Branagh Development are the owners of the subject property located at 100 .~.
School Street; and
WHEREAS, Chapter 32-72 of the Danville Municipal Code (Historic Preservation)
requires the Heritage Resource Commission review and recommend preservation
incentives for Town Council approval; and
WHEREAS, on September 27, 2005, the Planning Commission recommended approval
of the owner's request for Development Plan DP 2005-10; and
WHEREAS, on September 27, 2005, the Heritage Resource Commission conditionally
approved Development Plan DP 2005-10 that includes rehabilitation of the existing
historic home for adaptive use; demolition of the existing detached garage; relocation of
the existing historic home on the site forward on the parcel toward School Street and
construction of a new foundation; and construction of an attached 1,995+ / - square foot
addition and a 1,645 + / - square foot non-conditioned basement; and
WHEREAS, the property owners are concurrently requesting approval of designation
as a Heritage Resource and preservation incentives for 100 School Street; and
WHEREAS, on October 18, 2005, the Danville Town Council designated 100 School
Street as a Heritage Resource; and
WHEREAS, the Heritage Resource Commission adopted Resolution 2005-03 on__
September 27, 2005, recommending the Town Council approve preservation incentives
for 100 School Street; now, therefore, be it
RESOL VED, that the Danville Town Council approves preservation incentives for 100
School Street that include the following:
1. Expands the range of allowable uses that may occupy the historic structure to
include professional office use and residential use.
2. Waives the parking in-lieu fees of all structures on this site (equaling
approximately $88,164) provided that the owner agrees to implement a Parking
Management Plan for the site per the Conditions of Approval E.1 and E.2
imposed for DP 2005-10.
3. Commits the Town to assist the property owner in any efforts they undertake to
obtain Federal and / or State historic preservation grants and aid.
4. Authorizes the Town Manager, on behalf of the Town, to enter into and execute a
Mills Act Contract with the property owner, potentially providing for a
reduction in property taxes associated with the historic structure.
5. Waives Transportation Improvement Program (TIP) fees ($4.50 for 1,995 square
feet of conditioned space equaling $ 8,977.50).
6. Authorizes application of the provisions of the Historic Building Code to the
historic structure.
7. Waives all Planning application fees (equaling approximately $3,000).
8. Waives all Building Inspection- (except plan check fees), child care, storm water,
Engineering and Planning fees associated with the issuance of building permits
(equaling approximately $10,100).
9. Provides a Heritage Resource identification plaque for the site.
10. Includes the site in all marketing plans and public information brochures
developed to increase the puplic's awareness of the Town's Historic Preservation
Program.
