HomeMy WebLinkAbout060-05RESOLUTION NO. 60-2005 APPROVING REVOCABLE LICENSE AGREEMENTS (RAILROAD AVENUE AT LINDA MESA AVENUE IMPROVEMENTS) WITH JOHN SCHIRECK AND JACK AND ARLENE RUSS WHEREAS, the Town of Danville proposes to construct improvements at the northeast corner of Railroad Avenue and Linda Mesa Avenue as part of the Clock Tower Parking Lot Renovation (CIP A-413); and WHEREAS, the improvements will require reconfiguration of the private parking at 90 Railroad Avenue and 120 West Linda Mesa Avenue; and WHEREAS, the property owners at 90 Railroad Avenue, Mr. John Schireck, and at 120 West Linda Mesa Avenue (Mr. Jack Russ and Ms. Arlene Russ) have consented to the improvements and to the parking reconfiguration by each executing a Revocable License Agreement with the Town; and WHEREAS, the Revocable License Agreements allow.Mr. Schireck, Mr. and Ms. Russ, or their successors and assigns exclusive use of the right-of-way area behind the public sidewalk for parking during the term of the license; and WHEREAS, the licenses can be revoked by the Town only under specified circumstances; now, therefore, be it RESOLVED, by the Danville Town Council, that the Mayor is hereby authorized and directed to execute each of the two Revocable License Agreements on behalf of the Town; and, be it further RESOLVED, that the City Clerk shall forward each fully executed Revocable License Agreement to the Contra Costa County Recorder's Office for recording.
