HomeMy WebLinkAbout058-05RESOLUTION NO. 58-2005 AUTHORIZING THE TOWN MANAGER TO EXECUTE A REIMBURSEMENT AGREEMENT FOR MEADOW LAKE DRIVE IMPROVEMENTS-LAWRENCE ROAD BENEFIT DISTRICT WHEREAS, on February 20, 1996, the Town of Danville created the Lawrence Road Benefit District Reimbursement Agreement in order to help facilitate the construction of needed public infrastructure in the Lawrence Road Specific Plan area; and WHEREAS, the District was formed pursuant to the authority provided by Chapter 14 of the Danville Municipal Code and the Lawrence/Leema Road Specific Plan; and WHEREAS, Karlskind Development has agreed to construct certain improvements in Meadow Lake Drive as provided for by the District and the Specific Plan, subject to reimbursement by the District for amounts exceeding Karlskind's fair share; and WHEREAS, the District has sufficient funds reserved to reimburse Karlskind for the Meadow Lake Drive Improvements; and WHEREAS, the Town Council finds that the proposed improvements and reimbursement agreement are consistent with Chapter 14 of the Danville Municipal Code and with the provisions of the Lawrence Road Benefit District; now, therefOre, be it RESOLVED, that the Danville Town Council authorizes the Town Manager to execute a Reimbursement Agreement for Meadow Lake Drive Improvements-Lawrence Road Benefit District. APPROVED by the Danville Town Council at a regular meeting on June 7, 2005, by the following vote: AYES: Doyle, NOES: None ABSTAINED: None ABSENT: None Stepper, APPROVED AS TO FORM: Andersen, Arnerich, Shimansky MAYOR
