HomeMy WebLinkAbout046-05 RESOLUTION NO. 46-2005 AWARDING A CONSTRUCTION CONTRACT AND APPROPRIATING ADDITIONAL FUNDS FOR THE OSAGE STATION PARK SOUTH PARKING LOT RESTROOM, PROJECT B-294 WHEREAS, the Danville Town Council approved a call for bids for the Osage Station Park South Parking Lot Restroom, Project B-294; and WHEREAS, the City Clerk of this Town did, in open session on the 3rd day of May, 2005, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, the responsible low bidder is Biland Construction of Rio Vista, California, and the City Engineer has recommended awarding a construction contract for the project to said firm; and WHEREAS, funds for this project were appropriated in the Town's 5-Year Capital Improvement Program; and WHEREAS, this project is Categorically Exempt from the requirements of the California Environmental Quality Act, Section 15303, Class 3; now, therefore, be it RESOLVED, by the Danville Town Council, that the Town award the construction contract for the Osage Station Park South Parking Lot Restroom, Project B-294 to Biland Construction of Rio Vista, California; and, be it further RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is authorized to execute, on behalf of the Town, a written contract with Biland Construction, for a total of $333,550 for work in connection with the Osage Station Park South Parking Lot Restroom, Project B-294, in the form as lodged with the City Clerk, together with such changes as may hereafter be determined necessary, provided such changes do not materially increase the obligations to the Town thereunder, and to receive and approve all bonds in connection therewith, and the City Clerk is hereby directed to attest same and affix thereto the official seal of the Town; and, be it further RESOLVED, that the City Clerk shall within five (5) days of the adoption of this Resolution, transmit an Extract of Public Works contract award to the Department of Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to journeymen be made, the Town shall notify the Division of Apprenticeship Standards of such findings.); and, be it further RESOLVED, by the Danville Town Council, that an additional appropriation in the amount of $35,000 be made from the Park Fund to fully fund the construction contract.
