HomeMy WebLinkAbout040-05RESOLUTION NO. 40-2005 APPROVING A RIGHT-OF-WAY USE AGREEMENT WITH NEXTG NETWORKS WHEREAS, the Town of Danville manages and controls the public right-of-way within Danville; and WHEREAS, NextG Networks has requested permission to utilize the Town's right-of-way for the purpose of installing a system of antennas and fiber optic cable to provide telecommunications services to the Town's residents; and WHEREAS, NextG Networks has applied for and received a Certificate of Public Necessity from the California Public Utilities Commission, authorizing NextG to provide telecommunications services throughout the state; now, therefore, be it RESOLVED, that the Danville Town Council hereby approves a Right-of-Way Use Agreement with NextG Networks and authorizes the Town Manager to execute the agreement.
