HomeMy WebLinkAbout032-05RESOLUTION NO. 32-2005 AUTHORIZING THE INITIATION OF A GENERAL PLAN AMENDMENT STUDY FOR BLACKSMITH HOMES, LLC (APPLICANT AND OWNER) INVOLVING THE UNDEVELOPED 1.78-ACRE PARCEL LOCATED AT THE NORTHEAST CORNER OF THE INTERSECTION OF FOSTORIA WAY AND THE IRON HORSE TRAIL (APN 218-040-044) WHEREAS, Blacksmith Homes, LLC, has requested initiation of a General Plan Amendment Study involving the undeveloped 1.78+/- acre parcel located at the northeast comer of the intersection of Fostoria Way and the Iron Horse Trail (being further identified as Assessor's Parcel Number 218-040-044); and WHEREAS, the applicant has indicated that a Residential - Multiple Family - High/Medium Density land use designation (18 to 22 dwelling units per acre) be pursued through the general plan amendment study, with the applicant's preferred project being a 34-unit multiple family apartment condominium project; and WHEREAS, the current zoning designation (L-l; Light Industrial District) and the current general plan land use designation (Commercial - Controlled Manufacturing) for the subject property do not allow, as a use allowed by right, development of a residential project; and WHEREAS, the Town of Danville requires Town Council authorization prior to preparation of General Plan Amendment Studies; and WHEREAS, the Town Council did consider the applicant's request at a public hearing on April 5, 2005; and WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED, that the Danville Town Council concurs with the recommendation of staff and authorizes the preparation of a General Plan Amendment Study; and, be it further RESOLVED, given the unique location and mixture of land uses surrounding the subject property, it is appropriate to have the applicant submit alternative site and circulation plans for the site (i.e., plans for a light industrial use, an office use and for a multiple family residential use) and, be it further RESOLVED, that the Town Council directs that the submittal materials for the General Plan Amendment Study shall address potential land use compatibility, noise and traffic issues associated with the subject property's development; and, be it further RESOLVED, the applicant is directed to review and consider the architectural and land plan characteristics of the following high-quality residential projects recently developed in Danville for consideration of options for a residential - multiple family - low/medium density or high/medium density use on the property: Stony Brook - depicting a for-sale motor-court housing product providing for the 13 to 17 dwelling tmits per acre land use designation range; Sequoia Grove Apartments (aka "Podva Apartments") - depicting a for- rent housing product providing for the 18 to 22 dwelling units per acre land use designation; Ryland Cottages - depicting a for-sale single family detached housing product providing for the 7 to 12 dwelling traits per acre land use designation range; and, be it further RESOLVED, the applicant is directed' to review and consider the 164-unit condominium project occupying the eight-acre site situated to the west of the subject property with an understanding of a Town Council expectation that a residential project built on the subject property shall be of an equal, or higher, quality to that nearby multiple family residential project; and, be it further RESOLVED, the applicant is advised of a Town Council expectation that a residential project built on the subject property shall be constructed to condominium-quality standards and that consideration should be made to include enclosed garages for each residential unit in the project, similar to provisions made fin the Sequoia Grove Apartment project cited above, as this design feature is considered to be a desirable and appropriate amenity for the residential users of such a project; and, be it further RESOLVED, the applicant is advised of a Town Council expectation that a residential project built on the subject property shall include high quality, mature landscaping treatment as such landscaping will be key to blend such a project appropriately into surrounding land uses, which include residential uses to the north and west, the Iron PAGE 2 OF RESOLUTION NO. 32-2005 Horse Trail to the west, and commercial and industrial uses to the south and east; and, be it further J RESOLVED, that in authorizing the above-mentioned General Plan Amendment Study, the Town Council is not indicating any predisposition to approve the requested General Plan Amendment.
