HomeMy WebLinkAbout001-05RESOLUTION NO. 1-2005 ACCEPTING A GRANT OF RIGHT OF WAY FOR REAL PROPERTY TRANSFERRED FROM THE SAN RAMON VALLEY UNIFIED SCHOOL DISTRICT WHEREAS, the San Ramon Valley Unified School District ("District") is the owner of certain real property located at 968 Blemer Road in the Town of Danville, County of Contra Costa, State of California ("Property"); and WHEREAS, the Town of Danville ("Town") requires a right of way over a portion of the property for the construction, operation, and maintenance of public street and utility improvements; and WHEREAS, the property belonging to the District upon which the right of way will be located is not currently needed exclusively for classroom or other school purposes by the District; and WHEREAS, on November 16, 2004, the Board of Trustees of the District adopted a resolution of intention to dedicate a right of way pursuant to Education Code §17558 et seq. ("Code") to the Town; and WHEREAS, on December 14, 2004, the Board of Trustees of the District conducted a hearing pursuant to the Code and, having received no protest against the proposed dedication, adopted Resolution No. 27/04-05 authorizing the President of the Board of Trustees to execute a Grant of Right of Way deed granting a right of way to the Town; and WHEREAS, said executed Grant of Right of Way precisely describes the right of way to be granted and the specific terms of the conveyance; and WHEREAS, said executed Grant of Right of Way is hereby presented to the Town for acceptance; now, therefore, be it RESOLVED, that the Town of Danville hereby accepts the Grant of Right of Way conveyed by the District as described in the executed deed. The City Clerk is directed to attach a Certificate of Acceptance to the deed and have it recorded with the Contra Costa County Recorder's office together with a certified copy of this resolution.
