HomeMy WebLinkAbout084-04RESOLUTION NO. 84-2004 AUTHORIZING THE INITIATION OF A GENERAL PLAN AMENDMENT STUDY FOR FOSTORIA, LLC (APPLICANT AND OWNER) INVOLVING THE UNDEVELOPED 1.78-ACRE PARCEL AT 3420 FOSTORIA WAY (APN 218-040-042) WHEREAS, Fostoria, LLC, has requested initiation of a General Plan Amendment Study involving the 1.78+/- acre Fostoria, LLC parcel located at the northeast comer of the intersection of Fostoria Way and the Iron Horse Trail (i.e., the abandoned S.P.R.R. corridor with a site address identification of 3420 Fostoria Way and being further identified as Assessor's Parcel Numbers 218-040-042); and WHEREAS, the applicant is requesting a Commercial - Mixed Use land use designation for the property to allow the flexibility to develop the site with either a light industrial, office, multiple family residential - low/medium density (13 to 18 dwelling units per acre), or multiple family residential - high/medium density (18 to 22 dwelling units per acre) use; and WHEREAS, the current zoning designation (L-l; Light Industrial District) and the current general plan land use designation (Commercial - Controlled Manufacturing) for the subject property do not allow, as a' use allowed by right, development of residential uses or certain types of office uses; and WHEREAS, the Town of Danville requires Town Council authorization prior to preparation of General Plan Amendment Studies; and IArHEREAS, the Town Council did consider the applicant's request at a public hearing on July 6, 2004; and WHEREAS, the Town Council did hear and consider aH reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED, that the Danville Town Council concurs with the recommendation of staff and authorizes the preparation of a General Plan Amendment Study; and, be it further RESOLVED, given the unique location and mixture of land uses surrounding the subject property, it is appropriate to have the applicant submit alternative site and circulation plans for the site (i.e., plans for a light industrial use, an office use and for a residential use - which depicts options at varying densities and with varying product type) and, be it further RESOLVED, that the Town Council directs that the submittal materials for the General Plan Amendment Study shall address potential land use compatibility, noise and traffic issues associated with the subject property's development; and, be it further RESOLVED, the applicant is directed to review and consider the architectural and land plan characteristics of the following high-quality residential projects recently developed in Danville for consideration of options for a multiple family residential - low/medium density use on the property · Ryland Cottages - depicting a for-sale single family detached housing product providing for the 7 to 12 dwelling units per acre land use designation range; · Stony Brook - depicting a for-sale motor-court housing product providing for the 13 to 17 dwelling units per acre land use designation range; and · Sequoia Grove Apartments (aka "Podva Apartments") - depicting a for- rent housing product providing for the 18 to 22 dwelling units per acre land use designation, and, be it further RESOLVED, that in authorizing the above-mentioned General Plan Amendment Study, the Town Council is not indicating any predisposition to approve the requested General Plan Amendment.
