APPROVING A
HERITAGE RESOURCE INCENTIVE PACKAGE
FOR THE HISTORIC LOVE HOUSE
LOCATED AT 357 LOVE LANE
(APN: 199-220-030)
WHEREAS, Mark and Karen Davis, are the owners of the subject property located at 357
Love Lane; and
WHEREAS, on May 18, 2004, the Danville Town Council designated 357 Love Lane as a
Heritage Resource; and
WHEREAS, Chapter 32-72 of the Danville Municipal Code (Historic Preservation) requires
the Heritage Resource Commission review and recommend Heritage Resource incentive
packages for Town Council consideration; and
WHEREAS, on May 10, 2004, the Heritage Resource Commission approved Development
Plan DP 2004-08 which authorizes construction of a 581 +/- square foot addition and
exterior alterations to the existing Heritage Resource; and
WHEREAS, the property owners are also requesting approval of a Heritage Resource
incentive package related to the development proposal for 357 Love Lane; now, therefore,
be it
RESOLVED that the Danville Town Council approves a Heritage Resource incentive
package for 357 Love Lane that includes the following:
1. Commits the Town to assist the property owner in any efforts they undertake to
obtain Federal and/or State historic preservation grants and aid.
2. Authorizes the Town Manager, on behalf of the Town, to enter into and execute a
Mills Act Contract with the property owner, potentially providing for a reduction in
property taxes associated with the historic structure.
3. Authorizes application of the provisions of the Historic Building Code to the
historic structure.
4. Waives all Planning application fees (approximately $573).
5. Waives all Building Inspection fees except plan check fees associated with the
issuance of building permits and Contra Costa County Flood Control & Water
Conservation District fees (approximately $3,255).
6. Provides a Heritage Resource identification plaque for the site.
7. Includes the site in all marketing plans and public information brochures developed
to increase the public's awareness of the Town's Historic Preservation Program.
APPROVED by the Danville Town Council at a regular meeting on May 18, 2004, by the
following vote:
