HomeMy WebLinkAbout054-04RESOLUTION NO. 54-2004 APPROVING A MILLS ACT HISTORIC PROPERTY PRESERVATION AGREEMENT WITH THE OWNERS OF THE "FOSTER HOUSE" LOCATED AT 404 HARTZ AVENUE (APN~ 208-022-014) WHEREAS, Mason Properties LLC, the owners of the subject property, have requested approval of a Mills Act Historic Property Preservation Agreement for the "Foster House"; and WHEREAS, the subject site is located at 404 Hartz Avenue and is further identified as Assessor's Parcel Number 208-022-014; and WHEREAS, the Danville Town Cottncil approved the "Foster House" Heritage ~Resource designation on April 15, 2003; and WHEREAS, the Mills Act was established by the State of California as an incentive f6r property owners to preserve historic properties by means of reducing property taxes; and WHEREAS, the Mills Act Historic Property Preservation Agreement is attached hereto and marked as Attachment "E"; WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted to the Town Council recommending that the Mills Act Historic Property Preservation Agreement be approved; and WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Town Council of the Town of Danville hereby approves the Mills Act Historic Property Preservation Agreement and finds that: The structure is currently located on Lot 8 of Block 2 in the first subdivision plat Map of Danville recorded by John Hartz in 1891; 2. The historic name for the existing structure on the site is "Foster House"; o Research indicates that the existing structure is the second structure to be built on the site in 1926 due 'to a fire that destroyed the original Foster home; To date, the one-story structure has been utilized as a retail/office space with no alterations from its original condition; The existing structure on the site was built by Joe Foster in a craftsman style of architecture that was characteristic of the time period in which it was built; The structure has been and would be maintained in a manner consistent with the Town's Heritage Resource Design Guidelines and Danville Municipal Code Section 32-72; The negligible minor fiscal impact resulting from a reduction of property taxes collected by the Town is outweighed by the public benefit of preserving the "Foster House"; and be it FURTHER RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to make amendments to the Mills Act Historic Property Preservation Agreement with Mason Properties LLC in the form as lodged with the City Attorney, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town thereunder.
