AWARDING A CONTRACT FOR THE HAP MAGEE RANCH PARK
PLAY AREA AND GROUP PICNIC AREA PROJECT NOS. B-279 AND B-281
AND APPROPRIATING ADDITIONAL PROJECT FUNDING
WHEREAS, the Danville Town Council appropriated funding for the Hap
Magee Ranch Park Play Area and Group Picnic Area Projects in the 1998/1999
and 1999/2000 Capital Improvement Programs; and
WHEREAS, Hap Magee Ranch Park is a facility jointly developed, improved and
maintained by the Town and Contra Costa County, R-7A; and '
WHEREAS, The Town and the County are sharing the costs of these
improvements equally; and
WHEREAS, the Danville Town Council apProved the call for bids for Hap
Magee Ranch Park Play Area and Group Picnic Area Project Nos. B-279 and B-
281; and
WHEREAS, the City Clerk of the Town of Danville did, in open session on the
22na day of April 2004, publicly open and read aloud the sealed bids received as
required by law; and
WHEREAS, the low bidder is Goodland Landscape Construction of Tracy, CA,
and the City Engineer has recommended awarding a contract for the project to
said firm; now, therefore be it
RESOLVED, that previously appropriated funds from Project Nos. B-279 and B-
281 be utilized for said improvements and that an additional $177,351.30 be
appropriated from the Park Fund to be utilized for said improvements; and be it
further
RESOLVED, by the Danville Town Council that the Town award the contract for
the Hap Magee Ranch Park Play Area and Group Picnic Area Project Nos. B-279
and B-281 to Goodland Landscape Construction of Tracy CA; and, be it further
RESOLVED, by the Danville Town Council, that the Town Manager be and
hereby is authorized to execute, on behalf of the Town, a written contract with
Goodland Landscape Construction of Tracy, CA, for $585,949.36, plus, as needed,
a 10% construction contingency of $58,594.94 for a total of $644,544.30 for work in
connection with the Hap Magee Ranch Park Play Area and Group Picnic Area,
Capital Improvement Project Nos. B-279 and B-281, in the form lodged with the
City Clerk, together with such changes as may hereafter be determined
necessary, provided such changes do not materially increase the obligations of
the Town thereunder, and to receive and approve all bonds in connection
therewith, and the City Clerk is hereby directed to attest same and affix thereto
the official seal of the Town; and, be it further
RESOLVED, that the City Clerk shall within five (5) days of the adoption of this
resolution, transmit an Extract of Public Works contract award to the
Department of Industrial Relations, Division of Apprenticeship Standards, P.O.
Box 603, San Francisco, CA 94101. (Note: Should a finding of any discrepancy
regarding this ratio of apprentices to journeymen be made; the Town shall notify
the Division of Apprenticeship Standards of such findings.)
