AWARDING A CONTRACT FOR OSAGE STATION PARK ROSE GARDENS,
CAPITAL IMPROVEMENT PROJECT B-013 AND APPROPRIATING
ADDITIONAL FUNDING
WHEREAS, the cOnstruction of additional rose boxes will provide 'more opportunities for
Danville residents and support existing community efforts for the enjoyment of park
visitors; and
WHEREAS, expansion of the memorial rose box containers is included in Project B-013 of
the Town's Capital Improvement Program; and
WHEREAS, the City Clerk of the Town of Danville, did, in open session on the 8th day of
April, 2004, publicly open and read alou,d the sealed bids received as required by law; and
WHEREAS, the low bidder is J. W. Riley & Son, Inc. of Emeryville, CA and the City
Engineer has recommended awarding a contract for the project to said [irm; and
WHEREAS, the Parks and Leisure Services Commission did recommend to appropriate
additional funds from Park Fund to be utilized for contract construction costs; now,
therefore be it
RESOLVED, that funds from Project B-013 be utilized for said improvements; and, be it
further
RESOLVED, that an additional $105,979.55 in Park Fund monies be appropriated for said
improvements; and, be it further
RESOLVED, by the Danville Town Council that the Town award a contract for Osage
Station Park Rose Gardens expansion, Capital Improvement Project B-013, to J. W. Riley &
Son, Inc. of Emeryville, CA; and, be it further
RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is
authorized to execute, on behalf of the Town, a written contract with J. W. Riley & Son, Inc.
of Emeryville, CA for $140,890.50, plus, as needed, a 10% construction contingency of
$14,089 for a total of $154,979.55 for work in connection with the Osage Station Rose
Gardens, Capital Improvement Project B-013, in the form lodged with the City Clerk,
together with such changes as may hereafter be determined necessary, provided such
changes do not materially increase the obligations of the Town thereunder, and to receive
and approve all bonds in connection therewith, and the City Clerk is hereby directed to
attest same and affix thereto the official seal of. the Town; and, be it further
RESOLVED, that the City Clerk shall within five (5) days of the adoption of this resolution,
transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101.
(Note: Should a finding of any discrepancy regarding this ratio of apprentices to
journeymen is made, the Town shall notify the Division of Apprenticeship Standards of
such findings.)

following vote:
