Signature of Declarant or Agent determining tax--Firm Name RESOLUTION NO. 14-2004 VACATION OF EXCESS RIGHT-OF-WAY ON LAWRENCE ROAD RESOLUTION NO. 14-2004 APPROVING THE VACATION OF EXCESS RIGHT-OF-WAY ON LAWRENCE ROAD WHEREAS, the Streets and Highways Code, Division 9 Part 3, Chapter 4, Article 1, Subsection 8334 (a) permits summary vacation of excess street right-of-way; and WHEREAS, the Streets and Highway Code, Division 9 Part 3, Chapter 5, Article 1, Subsection 8340 (c) provides for the Town to retain all utility easements within the excess street right-of-way necessary to maintain existing facilities; and WHEREAS, the Lawrence/Leema Road Specific Plan was adopted by the Planning Commission and the Town Council on September 1,1992 thereby establishing a road right- of-way width for Lawrence Road of 52 feet confirming that the vacation of excess right-of- way in is conformance with the General Plan; and WHEREAS, as a result of right-of-way dedication and offers of dedication there is excess road right-of-way on Lawrence Road; now, therefore, be it RESOLVED, by the Danville Town Council that the following findings are made: The summary vacation is made per Division 9, Part 3, Chapter 4, section 8334 of the California Streets and Highway Code. The excess right-of-way is on Lawrence Road as described in the attached legal descriptions (Exhibit 1). The excess right-of-way is no longer needed due to the adoption of the Lawrence/Leema Specific Plan and the adopted typical roadway sections. The excess right-of-way on Lawrence Road is not required for street or highway purposes; and, be it further; That from and after the date the resolution is recorded, the street vacated no longer constitutes a street, highway, or public service easement. RESOLVED, that the City Clerk is hereby authorized and directed to record a certified copy of this Resolution, attested by the City Clerk under seal, to be recorded without acknowledgment, certificate of acknowledgment, or further proof in the office of the recorder of Contra Costa County.
