HomeMy WebLinkAbout116-03RESOLUTION NO. 116-2003 AUTHORIZING THE TOWN MANAGER TO EXECUTE AN AFFORDABLE HOUSING AGREEMENT FOR THE FOR-SALE MODERATE INCOME UNITS REQUIRED TO BE ESTABLISHED IN PUD 2002-03/SD 8624 "TASSAJARA COTTAGES" - STANDARD PACIFIC OF NORTHERN CALIFORNIA (100 CENTER COURT) WHEREAS, on June 17, 2003, the Danville Town Council adopted Resolution No. 73-2003 approving Planned Unit Development - Rezoning request PUD 2002-03 and Final Development Plan / Major Subdivision request SD 8624 to construct a 21-unit single family residential project on a three-acre property located at the western terminus of Center Court in the eastern portions of Danville; and WHEREAS, the action provides for the construction of a 21-unit single family residential project over three-acre property located at 100 Center Court (being further identified as APN# 206-010-048); and WHEREAS, conditions of approval for the project require that the applicant, Standard Pacific of Northern California construct a total of two units which shall have sale prices that do not exceed the maximum price affordable to a four-person household earning 110% of the median income established for Contra Costa and Alameda Counties; and WHEREAS, Standard Pacific of Northern California is required to execute an Affordable Housing Agreement ("Agreement") with the Town of Danville regulating the occupancy, sale and resale of the affordable housing units; and WHEREAS, promoting the development of affordable housing within the Town of Danville is a goal of the adopted Danville Housing Element Update of the Town of Danville; and WHEREAS, the Town Council reviewed the agreement submitted by Standard Pacific of Northern California for the regulation of occupancy, sale and resale of the affordable housing units in the subject development on November 18, 2003; and WHEREAS, a staff report was submitted recommending that the Town Council approve the agreement with Standard Pacific of Northern California for the affordable housing units; now, therefore, be it RESOLVED, that the Danville Town Council hereby finds that the agreement regulating the occupancy, sale and resale for the four affordable housing units to be developed within PUD 2002-03 / SD 8624 is appropriate; and be it further RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to execute the Affordable Housing Agreement with Standard Pacific of Northern California in the form as submitted to the City Clerk, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town.
