SECTION ~l. DECL~RATION OF POLICY
The regulations con~ained in this policy are to be used as an
adjunct to the Uoise Control ordinance adopted by the Town of
Danville. These re3~lations are intended to provide guidelines
for the implementation and enforcement of the Noise Control
ordinance as required by Section 7-808. A~ evaluation of the
source of noise under these guidelines is one of several factors
to be considered in determiningwhether aviolation of the
Municipal Code exists. It is the poli:y of the Town of Danville
to encourage all residents and businessp.S to conform to the
standards contained herein.
SECTION "2. DEFINITIONS

The following definitions apply to these guidelines:
A. A-weighted Sound Level. The sound level in deci-
bels as measured on a sound level meter using the A-weighting
network. The level so read is designated 1B{A) or dBA.
B. Ambient Noise Level. The composite of noise from
all sources near and far. In this context, the ambient level

constitutes the normal or existing level of environmental noise
at a given location, minus the source which is the subject of
enforcement.
c. Decibels (dBA). A unit for measuring the ampli-
tude of sound, equal to 2~ times the logarithm to the base l~ of
the ratio of the pressure of the sound measured to the reference
pressur~, which is 20 micropascals.
D. Impulsive Sound. Sound of short duration, usual-
ly less than one second, with an abrupt onset and rapid decay.
Examples of sources of impulsive sound include explosions, drop
forge impacts, and discharge of firearms.
E. Intrusive Noise. That noise which intrudes over
and above the existing ambient noise at a given location. "The
relative intrusiveness of a sound depends upon its amplitude,
duration, frequency and time of occurrence, c~a tonal or informa-
tional content as well as the prevailing ambient noise level.
F. Noise Zone. Any defined areas or regions of a
generally consistent land use wherein the ambient noise levels
are within a range of 5 dB. (Typically, all sites within any
given noise zone will be of comparable proximity to major noise
sources. )
G. Noise Level. The maximum continuous sound level
or repetitive peak sound level, produced by a source or group of
sources as measured with a precision sound level meter. In order
to measure a noise level, the controls of the precision sound
level meter should be arranged to the setting appropriate to the
type of noise being measured.
H. Precision Sound Level Meter. A device for

measuring sound level in decibel units within the performance
specifications in the American National Standards Institutp.
Standard S1.4, or successor reference, "Specification for Sound
Level Meters."
I. Property Plane. A vertical plane extending from
the property line along the ground surface, which s~parates the
real property owned by one person from that owned by another
person, but not including intra-building real property divisions.
SECTION 03. MAXIMUM PER~ISSIBLE NOISE LEVELS BY RECEIVING LAND
USE.
(a) The noise st:\ndards in Table 1 apply unless other-
wise specifically indi~~ted.
(b) t~ois~ is presumed to be excessive and to cause
annoyance and disconfort to reasonable persons if the noise
causes the noise level when measured on a~y other property to
exceed:
(1) the noise standarj for that zone for a cumulative
period of more than thirty minut~s in any hour:
or
(2) the noise standard plus 5 dB for a cumulative
period of more than fifteen minutes in any hour:
or
(3) The noise standard plus 10 dB for a cumulative
period of more than five minutes in any hour: or
(4) the noise standard plus 15 dB for a cumulative
period of more than one minute in any hour: or
(5) the noise standard plus 20 dB for any period of
time.
(c) If possible, the ambient noise level should be
measured at the same location along the property line utilized in
Section C(J3.(b) with the alleged offending noise source inopera-

tive. If the intruding noise source is continuous and cannot
reasonably be discontinued or stopped for a time period whereby
the ambient noise level can be measured, the ambient noise level
may be determined by travelling away from the noise source to a
point Where a steady stat~ decibel reading is achieved. If this
test is not possible, the noise level measured while the source
is in operation shall be compared directly with the noise level
standards in Table 1 for the appropriate noise zone.
(d) If the measured local ambient exceeds the standard
in Table 1, within any of the first four noise limit categories
above, the allowable noise exposure standar~ shall be increased
in 5 dB increments in each category as appropriate to encompass
or reflect said ambient noise level.
(e) If the measurement location is on a boundary between
two different zones, the sound level limi~ applicable to the
quieter noise zone shall apply.
(f) If the alleged offensive noisa contains a steady,
audible tone such as a whine, screech, or hum, or is an impulsive
noise such as hammering, or contains music or speech conveying
informational content, the standard limits set forth in Table 1
shall be reduced by 5 dB.

The classification of different areas of the community in terms
of environmental noise zones shall be determined by the noise
control officer and recorded on a map entitled Noise Zones.
SECTION "4. NOISE MEASUREMENT PROCEDURES

(a) Upon receipt of a complaint from a citizen, the
noise control officer will review the standards in the noise
control ordinance to determine whether a violation of the noise
control ordinance may have occurred. If the noise control offi-

cer reasonably ~elieves there is probable cause to suspect a
violation of the noise control ordinance, the noise control
officer may make and record sound level measurements.
If sound
level measurements are made, the noise control officer shall
record all information pertinent to the complaint, including the
following:
(1) Type of noise source.
(2) Location of noise source relative to com-
plainant's property.
(3) Tine period during which noise source is con-
sidered by complainant to be intrusive.
(4) Total duration of noise produced by noise source.
(5) Date and time of noise measurement survey.
(6) Height and location of the sound level meter
microphone.
(7) Other factors listed in Muni=ipal Code Section
7 -SeJ3 .

(b) Using t~e "A" Weighting scale of the sound level
sounds), the noise control officer shall measure the noise level
at a position or positions along the complainant's property line
closest to the noise source or at the location along the boundary
line where the noise level is at maximum. Where possible, the
microphone sha 11 be located five feet above the ground and six
feet or more from the nearest reflective su~face. However, in
those cases where another elevation is deemed appropriate, the
latter shall be utilized. The noise control officer shall calib-
rate the meter immediately before to the measurements.
(c) The nois: measurement survey shall include a measure-
ment of the exis~ing local ambient noise level (without the
offending source), if possible, and the noise levels with the
alleged offending source.
SECTION 05. MAXI~ro~ PERMISSIBLE DWELLING INTERIOR SOUND LEVELS
Noise is presumed to be excessive and to cause annoyance and
discomfort to reasonab 1 e per sons if the no ise wi thin mul ti- fami 1 y
residential property, exceeds a noise level more than 6 dB above
the local ambient noise when measured three feet from any wall,
floor, or cp.iling insi1e any dwelling unit on the same property
when the windows a~j doors of the dwelling unit are in their
normal seasonal configur~tion.
Interior noise levels are not established for single family
areas as it is presumed that the outdoor ambient levels will
protect residents that are inside a structure on the singt"e---'--
family property.
SECTION 06. EXCE?~IONS: SPECIAL NOISE SOURCES.
Notwithstanding the general provisions of these regulations cer-
tain sources of noise may exceed the noise standards for a noise
zone provided they do not exceed the maximum noise level speci-
fied in Table 2. Noise level shall be determined by measuring at
the property plane, unless otherwise specified.

SECTION 07. EXCEPTIONS: OTHER
(a) These regulations are guide1 ines to be used in con-
junction with Municipal Code Sections 7-801 through 7-808(Noise
Control Ordinance). The ordinance provides for the granting of
exceptions to the ordinance, and implicit in this is the granting
of exceptions to the criteria contained in these guidelines.
(b) Existing commercial sweeping and maintenance
operations exist which may be considered for exceptions as to
hours of operation or other special conditions.
(c) Any permit relating to hours of operation that are
existing prior to preparation of these guidelines is considered
