HomeMy WebLinkAbout065-86 RESOLUTION NO. 65-86 A RESOLUTION PRELIMINARILY APPROVING THE ENGINEER'S REPORT DECLARING INTENT TO ORDER LEVY AND COLLECTION OF ASSESSMENTS AND PROVIDING FOR NOTICE OF HEARING THEREOF DANVILLE STREET LIGHTING AND LANDSCAPE ASSESSMENT DISTRICT 1983-1 RESOLVED, by the City Council of the City of Danvi11e, County of Contra Costa, California, that: 1. On May 19, 1986, this City Council adopted Resolution No. 59-86. A Resolution directing preparation of annual report for the Danville Street Lighting and Landscape Assessment District 1983-1, (the "District"). Pursuant to said resolution, a report, in accordance with Section 22565 et seg. of the California Streets and Highways Code, has been made, filed with the City Clerk, duly considered by this Council, and is hereby deemed sufficient and preliminarily approved. Said report shall stand as the Engineer's Report for all subsequent proceedings under and pursuant to the foregoing resolution. 2. It is the intention of this City Council to levy and collect assessments within the Danville Street Lighting and Landscape Assessment District 1983-1 for the fiscal year 1986-87. Within said District, the existing and proposed improvements and any substantial changes proposed to be made to the existing improvements are generally as described on Exhibit A attached hereto and hereby made a part hereof. 3. Said District consists of all of those portions of the former county service areas, L-42, M-6, M-21, and M-22, located within the area bounded by the corporate limits of the City of Danville, County of Contra Costa, California. 4. Reference is hereby made to the aforementioned Engineer's Report, on file with the City Clerk, for a full and detailed description of the improvements, the boundaries of the proposed maintenance assessment district and the proposed assessments upon assessable lots and parcels of land within said district. 5. Notice is hereby given that on Monday, the 4th day of August, 1986, at the hour of 7:30 o'clock p.m., in the regular meeting place of this City Council, 699 Old Orchard Drive, Danville, California, a hearing by the City Council will be held on the question of the levy of the proposed assessment. Prior to the conclusion of said hearing, any interested person may file a written protest with said Clerk, or, having previously filed a protest, may file a written withdrawal of that protest. A written protest shall state all grounds of objection. A protest by a property owner shall contain a description sufficient to identify the property owned by such owner. 6. The City Clerk shall cause notice of said hearing to be given by publishing a copy of this resolution once, at least ten (10) days prior to the date of the hearing above specified, in the Valley Times, a newspaper circulated in the City of Danville. PASSED, APPROVED AND ADOPTED on this 21st day of July by the fol~owing vote: AYES: Kennett, Lane, McNeely, Schlendorf , 1986 NOES: None ABSTAIN: None ABSENT: Offenhartz ~ 1i1M1~ Mayor ATTEST: ~ ~ t:d/ cit Clerk EXHIBIT A Description of Improvements The "Danville Street Lighting and Landscape Assessment District No. 1983-1" provides for the levy and collection of assessments sufficient to pay for improvements generally described as follows: The installation of landscaping, public lighting facilities and facilities appurtenant thereto or which are necessary or convenient for their maintenance or servicing, and the maintenance or servicing of the foregoing. The improvements for the 1986/87 fiscal year would be limited to the servicing or maintenance, or both of existing public lighting facilities. A reserve for landscaping of public streets within the district, will be maintained commencing with the 1986/87 fiscal year. The Sycamore Valley Specific Plan area is expected to be annexed into the district in the 1986/87 fiscal year, but would be funded independently until the 1987/88 fiscal year. IV ASSESSMENT DIAGRAM (Description) The attached Assessment Diagram consists of .8 each 18'x26" sheets which indicate the Danville City Limits, the boundaries of the Assessment District and the Contra Costa County Assessor's parcel book and page numbers. Reference has thereby been made to the maps on file with the County Assessor for the detailed description of the lines and dimensions of the various lots or parcels within the district. Each parcel within the district has been given a distinct number, that number being the assessor's parcel number as shown on the 1986/87 equalized assessment roll. V ASSESSMENT (Method) The total amount of cost and expenses has been assessed and apportioned among the parcels of land liable therefore and benefited thereby, and numbered on the attached assessment roll to correspond with the numbers on the" attached diagram. The assessment numbers are the Assessor's parcel numbers as shown on the 1986/87 equalized assessment roll. The assessment is made upon the several parcels of land within the Assessment District in proportion to the estimated benefits to be received by the parcels, respectively, from the improvements. The degree of benefit is determined by the use of the land of each individual parcel, the intensity of illumination provided, the number of pedestrians generated by the land use, and the enhanced security during hours of darkness. It is assumed that similar land uses will receive similar benefits. As an example, all single dwelling units are assumed to receive the same benefit and further that the single dwelling unit establishes the basis for the street lighting assessment; hence, multiple dwelling units, containing 2, 3, and 4, etc., units, are assumed to receive increased benefits as the number of dwelling units increases. Exhibit A attached lists the recommended street lighting units by class of property based on the intensity of street lighting, pedestrian and security factors as well as the total units for each class. The basic unit rate is computed by dividing the total fund requirement by the total units in the proposed district. The street lighting assessment for a parcel is the basic unit rate times the number of units for the class of the parcel. The boundaries of the proposed assessment district include all of those portions of the former county service areas of L-42, M-6, M-2l and M-22 which are within the incorporated limits of the City of Danville except as modified to include recently subdivided lands having public lighting facilities. The purpose of this report is to determine the levy of the annual assessment for the 1986/87 fiscal year. II DESCRIPTION OF IMPROVEMENTS The proposed "Danville Street Lighting and Landscape Assessment District No. 1983-1" is intended to provide for the levy and collection of assessments sufficient to pay for improvements generally described as follows: The installation of landscaping, public lighting facilities and facilities appurtenant thereto or which are necessary or convenient for their maintenance or servicing, and the maintenance or servicing of the foregoing. The improvements for the 1986/87 fiscal year would be limited to the servicing or maintenance, or both of existing public lighting facilities, and arterial landscaping. Plans and a street lighting detail list which show the general nature, location and extent of the existing public lighting facilities within the proposed district are bound separately and are made a part of this report by reference. A reserve for landscaping of public streets within the district, will be maintained commencing with the 1986/87 fiscal year. The Sycamore Valley Specific Plan area is expected to be annexed into the district in the 1986/87 Fiscal year, but would be funded independently until the 1987/88 Fiscal year. No other substantial changes in the existing improvements are roposed for the 1986/87 fiscal year.
