HomeMy WebLinkAbout2009-01 y ORDINANCE NO. 2009-01 APPROVING PRELIMINARY DEVELOPMENT PLAN - REZONING REQUEST PUD 2004-04, REZONING A 15 +/- ACRE SITE FROM R-20; SINGLE F AMIL Y RESIDENTIAL DISTRICT TO P-l; PLANNED UNIT. DEVELOPMENT DISTRICT ALLOWING THE DEVELOPMENT OF 22 SINGLE FAMILY HOMES AND ONE 3.7+/- ACRE LIFE ESTATE PARCEL The Town Council of the Town of Danville does ordain as follows: SECTION 1. Rezoning. The 15 + / - acre site, located at 333 Hill Road, further identified as As~essor' s Parcel Numbers 196-310-002,004, is rezoned from R-20; Single Family Residential District to P- I; Planned Unit Development District (PUD 2004-04). Rezoning is based upon approved Final Development Plan - Major Subdivision SD 8919 and approved Tree Removal TR 2006-02 and the findings and conditions of approval contained within Town Council Resolution No. 37-2009. Resolution No. 37-2009, and all attachments thereto, is hereby incorporat~d by reference. SECTION 2. Zoning Map. The zohiuKmap has been -amended accordingly. SECTION 3. Publication. The City Clerk shall either a) have this ordinance published once within 15 days after adoption in a newspaper of general circulation or b) have a summary of this ordinance published twice in a newspaper of general circulation once five days before its adoption and again within 15 days after adoption. SECTION 4. Effective Date. This ordinance becomes effective 30 days after its adoption. The foregoing ordinance was first read and introduced on April 21, 2009, and approved and adopted by the Danville Town Council at a regular meeting on May 5, 2009 by the following vote: AYES: - Arnerich, Doyle~ Andersen, Shimansky, Stepper NOES: - None ABSTAIN: - None ABSENT: - None APPROVED AS TO FORM: ~13~ CITY ATfORNEY ~ CLERK'S CERTIFICATE I, Marie Sunseri, City Clerk of the Town of Danville, hereby certify that the foregoing is a true and accurate copy of Ordinance No. 2009-01 of said Town and that said ordinance was published according to law.
