HomeMy WebLinkAbout2008-05 ORDINANCE NO. 2008-05 ADDING A NEW SECTION 10-8 TO THE DANVILLE MUNICIPAL CODE APPROVING THE OFFICE OF THE STATE FIRE MARSHAL MAP OF THE VERY HIGH FIRE SEVERITY ZONE WITHIN THE WILDLAND-URBAN INTERFACE FIRE AREA The Danville Town Council does ordain as follows: SECTION 1. ADDING A NEW SECTION 10-8 TO THE DANVILLE MUNICIPAL CODE. A new Section 10-8 is hereby added to the Danville Municipal Code to read as follows: SECTION 10-8 VERY HIGH FIRE HAZARD SEVERITY ZONE 10-8.1 Definitions. For the purposes of this section, certain terms shall be defined as follows: (a) "Wildland-Urban Interface Fire Area" is a geographical area identified by the state as a "Fire Hazard Severity Zone" in accordance with the Public Resources Code Sections 4201 through 4204 and Government Code Sections 51175 through 51189, or other areas designated by the enforcing agency to be at a significant risk from wildfires. (b) "Very High Fire Hazard Severity Zone" refers to the designated area on the Wildland-Urban Interface Fire Area map (Exhibit 1) published by the Office of the State Fire Marshal. 10-8.2 Designation of Very High Fire Hazard Severity Zones. The recommendations of the Director of the California Department of Forestry and Fire Protection designating very high fire hazard severity zones within the Town of Danville are hereby adopted. These zones are depicted graphically on the map prepared by the Department of Forestry and Fire Protection, which map is hereby adopted by reference. 10-8.3 Scope. This section applies to building materials, systems and/ or assemblies used in the exterior design and construction of new buildings located within a Wildland-Urban Interface Fire Area as defined in Chapter 7 A in the California Building Code. 10-8.4 General requirements. New buildings located in any Very High Fire Hazard Severity Zone for which an application for a building permit is submitted on or after July I, 2008 shall comply with Chapter 7 A in the California Building Code. The building official may approve alternate ignition-resistant materials in the construction of new buildings within a Very High Fire Hazard Severity Zone provided sufficient evidence is submitted for the testing of said materials. 10-8.5 Enforcing agency. The Building Division shall administer and enforce the provisions of this ordinance. SECTION 2. CODIFICATION. Section 1 of this ordinance shall be codified in the Danville Municipal Code. SECTION 3. PUBLICATION AND EFFECTIVE DATE. The City Clerk shall have this ordinance published once within 15 (fifteen) days after adoption in a newspaper of general circulation. This ordinance shall become effective 30 days after adoption. SECTION 4. SEVERABILITY. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of the ordinance. The Danville Town Council hereby declares that they would have adopted the ordinance, and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that one or more sections, subsections, sentences, clauses or phrases was declared invalid.
