HomeMy WebLinkAbout2005-06 ORDINANCE NO. 2005-06 APPROVING PRELIMINARY DEVELOPMENT PLAN - REZONING REQUEST PUD 2005-03 -- DOWNTOWN BUSINESS DISTRICTS The Town Council of the Town of Danville does ordain as follows: SECTION 1. Rezoning and Zoning Map Certain Downtown Danville properties are rezoned from Downtown Business District 2: Old Town Retail Transition District to Downtown Business District 2: Old Town Retail District (PUD 2005-03). The affected properties are generally those DBD - Area 2 properties located along the east side of Railroad A venue between Prospect Avenue and School Street, which have not previously redeveloped, and are not rezoned under Section 3 of this Ordinance. These properties are also identified as Assessor Parcel Numbers: 208-026-013, 208-025-06, 208-025-16, 208-023-17, 208-023-018, 208-023-025, 208-023-026, 199-350-030, 199-350-034, 199-350-039. Rezoning is based upon the applicable development standards contained within Town Municipal Code Section 32-45 - Downtown Business District, as amended under Zoning Text Amendment ZTA 2005-01 as contained within Town Ordinance No. 2005- 07. Town Ordinance No. 2005-07, and all attachments thereto, is hereby incorporated by reference. The Zoning Map of the Town of Danville is amended accordingly. IiQ/f.... SECTION 2. Rezoning and Zoning Map Certain Downtown Danville properties are rezoned from Downtown Business District 2: Old Town Retail Transition District to a new Downtown Business District 2A: Old Town Retail District (PUD 2005-03). The affected properties are generally those DBD - Area 2 properties located along the east side of Railroad Avenue between San Ramon Valley Boulevard and Linda Mesa, and several properties on the east side of Railroad Avenue between Prospect Avenue and San Ramon Valley Boulevard not rezoned per Section 1 of this Ordinance. These properties are also identified as Assessor Parcel Numbers: 208-026-019,208-026-020,208-025-010, 208-025-018, 208-023-020, 208-340-004, 208-340-005, 208-340-006, 208-340-007. Rezoning is based upon the applicable development standards contained within Town Municipal Code Section 32-45 - Downtown Business District, as amended under Zoning Text Amendment ZT A 2005-01 as contained within Town Ordinance No. 2005- 07. Town Ordinance No. 2005-07, and all attachments thereto, is hereby incorporated by reference. The Zoning Map of the Town of Danville is amended accordingly. SECTION 3. Rezoning and Zoning Map Certain Downtown Danville properties are rezoned from Downtown Business Districts 1,2 and 4 to new Downtown Business District 11: Special Opportunities District (PUD 2005-03). The affected properties include the Faz Restaurant property, the Danville PAGE 2 OF ORDINANCE NO. 2005-06 Hotel property, and properties at the northern limits of the Downtown area north of Linda Mesa A venue and fronting along Rose A venue, Hartz Avenue and Railroad Avenue. These properties are also identified as Assessor Parcel Numbers: 208-022-041, 208-023-003, 208-023-004, 208-023-008, 208-023-009, 208-023-024, 208-010-023, 199-330- 006, 199-330-008, 199-330-009, 199-330-010, 199-330-011, 208-330-013, 208-330-013, 208- 330-027, 208-330-290, 208-330-034, 208-330-035, 208-330-051, 208-330-052, 208-330-054, 208-330-055, 208-330-056, 208-190-007, 208-190-010, 200-190-014, 200-190-017, 200-190- 018, 200-190-020, 200-190-021, 200-190-022, 200-190-023, 200-190-024, 200-190-028, 200- 190-026. Rez_oning is based upon the applicable development standards contained within Town Municipal Code Section 32-45 - Downtown Business District, as amended under Zoning Text Amendment ZTA 2005-01 as contained within Town Ordinance No. 2005- 07. Town Ordinance No. 2005-07, and all attachments thereto, is hereby incorporated by reference. The rezoning action described within this section shall be in effect for a period of three years from the effective date of this rezoning. After this three year period, the zoning of these parcels shall revert to the zoning districts previously in effect. The Zoning Map of the Towri of Danville is amended accordingly. PAGE 3 OF ORDINANCE NO. 2005-06 SECTION 4. Publication. The City Clerk shall either a) have this ordinance published once within 15 days after adoption in a newspaper of general circulation or b) have a summary of this ordinance published twice in a newspaper of general circulation once five days before its adoption and again within 15 days after adoption. SECTION 5. Effective Date. This ordinance becomes effective 30 days after its adoption.
