AMENDING THE REDEVELOPMENT PLAN FOR THE
DOWNTOWN REDEVELOPMENT PROJECT
TO EXTEND THE EFFECTIVE TERM OF THE PLAN
The Danville Town Council does ordain as follows:
SECTION 1. FINDINGS.
The Danville Town Council adopted Ordinance No. 94 on July 14, 1986, approving
and adopting the Redevelopment Plan for the Downtown Redevelopment Project
(the "Plan").
In 1994, the Town Council adopted Ordinance No. 94-23, establishing timelines for
the last effective date of the Plan and the last date to receive tax increment to repay
debt, as required by AB 1290.

In 1999, the Town Council adopted Ordinance No. 99-04, extending the effective
term of the Plan to 40 years, as provided for in AB 1342. Based on previous actions,
the current last effective date of the Plan is July 14, 2026 and the last date to receive
increment to repay debt is July 14, 2036.
In response to the State of California's budget crisis, the State adopted SB 1045,
taking tax increment revenues from all local redevelopment agencies in order to
fund the Education Revenue Augmentation Fund ("ERAF'). In order to help
compensate for this takeaway, SB 1045 allows local agencies to extend the effective
date and last date to collect increment by one year. This extension can be
accomplished by adoption of an ordinance.
SECTION 2. REDEVELOPMENT PLAN AMENDED.
Section 800 of the Redevelopment Plan for the Downtown Redevelopment Project is
hereby amended to provide that the effective term of the Plan shall be forty one (41)
years from the date the Plan was first adopted by the Town Council. The last date to
receive increment shall remain 10 years after the effective date specified herein. Except
as provided herein, Ordinance No. 94 and Ordinance No. 94-23 are continued in full
force and effect.
SECTION 3. CODIFICATION.
This ordinance shall not be codified in the Danville Municipal Code.
SECTION 4. PUBLICATION AND EFFECTIVE DATE. The City Clerk shall have
this ordinance published in a newspaper of general circulation within fifteen (15) days
after adoption. This ordinance shall become effective 30 days after adoption.
The foregoing Ordinance was introduced on June 7, 2005 and approved and adopted by
the Danville Town Council at a regular meeting held on June 21, 2005, by the following
vote:
