HomeMy WebLinkAbout2005-03ORDINANCE NO. 2005-03 APPROVING PRELIMINARY DEVELOPMENT PLAN REZONING REQUEST PUD 2004-03 The Town Council of the Town of Danville does ordain as follows: SECTION 1. Rezoning. The 2.05 +/- acre site, located at 102, 104, and 106 Edinburgh Circle, further identified as Assessor's Parcel Numbers 202-281-020,021,&022, is rezoned from R-15; Single Family Residential District to a P-l; Planned Unit Development District. Rezoning is based upon approved Final Development Plan - Major Subdivision request SD 8624, which will create a total of five parcels and the findings and conditions of approval contained within Town Council Resolution No. 42-2005. Resolution No. 42-2005, and all attachments thereto, are hereby incorporated by reference. SECTION 2. Zoning Map. The Zoning Map of the Town of Danville is amended accordingly. SECTION 3. Publication. The City Clerk shall either a) have this ordinance published once within 15 days after adoption in a newspaper of general circulation or b) have a summary of this ordinance published twice in a newspaper of general circulation once five days before its adoption and again within 15 days after adoption. SECTION 4. Effective Date. This ordinance becomes effective 30 days after its adoption. The foregoing ordinance was first read and introduced on May 3, 2005 and approved and adopted by the Danville Town Council at a regular meeting on May 17, 2005, by the following vote: AYES: Doyle, Stepper, NOES: None ABSTAIN: None ABSENT: Andersen Arnerich, Shimansky /r~&~?.~_(7~..PPROVED AS TO FORM: CITY ATTORNEY CLERK'S CERTIFICATE I, Marie Sunseri, City Clerk of the Town of Danville, hereby certify that the foregoing is a true and accurate copy of Ordinance No. 2005-03 of said Town and that said ordinance was published according to law.
